1 AN ACT to amend the Clerks of Courts Act by adding
2 Section 30.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Clerks of Courts Act is amended by adding
6 Section 30 as follows:
7 (705 ILCS 105/30 new)
8 Sec. 30. Appointment of attorney to represent clerk.
9 (a) Subject to appropriations for that purpose by the
10 county board, the clerk may appoint an attorney licensed to
11 practice law in Illinois to represent the interest of the
12 clerk in the following matters:
13 (1) Collection of debts due and owing to the clerk.
14 (2) Collection of child support administrative fees.
15 (3) Collection of unpaid fees.
16 (4) Collection of amounts due and owing to the clerk
17 but not paid because there were insufficient funds in an
18 account on which a check payable to the clerk was drawn.
19 (5) Review of contracts proposed to be entered into
20 by the clerk or otherwise affecting the clerk.
21 The clerk may appoint an attorney under this Section on
22 either a full-time or a part-time basis.
23 (b) The appointment of an attorney under this Section
24 does not relieve either the Attorney General or the State's
25 Attorney of his or her duty, in any action against the clerk,
26 to defend the officers, employees, and agents of the county.
27 (c) An attorney appointed under this Section is entitled
28 to the same immunity from civil and criminal liability as the
29 clerk.
30 Section 99. Effective date. This Act takes effect upon
