91_HB1782eng HB1782 Engrossed LRB9103869MWpk 1 AN ACT to amend the Election Code by adding Section 2 29-14.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by adding 6 Section 29-14.5 as follows: 7 (10 ILCS 5/29-14.5 new) 8 Sec. 29-14.5. Push-polling. 9 (a) Any person engaging in push-polling must (i) inform 10 the person contacted that the call is being made on behalf 11 of, in support of, or in opposition to a particular 12 candidate, (ii) identify that candidate by name, and (iii) 13 provide the telephone number of the place from which the 14 push-polling is conducted. 15 (b) A person who violates this Section is guilty of a 16 Class A misdemeanor. 17 (c) For the purposes of this Section, "push-polling" 18 means (i) calling voters on behalf of, in support of, or in 19 opposition to any candidate for public office; (ii) asking 20 questions relating to opposing candidates for that public 21 office that state, imply, or convey information about the 22 opposing candidates' character, status, or political stance 23 or record; and (iii) conducting the call in a manner that is 24 likely to be construed by the person receiving the call to be 25 a survey or poll to gather statistical data for entities or 26 organizations that are acting independently of any political 27 party, candidate, or interest group.
