1 AN ACT to amend the School Code by changing Section 1-4.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by changing
5 Section 1-4 as follows:
6 (105 ILCS 5/1-4) (from Ch. 122, par. 1-4)
7 Sec. 1-4. Policy; intent. It is the policy of this
8 State that all powers granted, either expressly or by
9 necessary implication, by this Act, other Illinois statute,
10 or the Illinois Constitution to any public school district
11 may be exercised by those public school districts
12 notwithstanding effects on competition. It is the intention
13 of the General Assembly that the "State action exemption" to
14 the application of federal antitrust statutes be fully
15 available to all public school districts to the extent their
16 activities are authorized by law as stated herein.
