 1        AN  ACT  to  amend  the  Criminal  Code of 1961 by adding
 2    Section 31-5.5.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Criminal  Code  of  1961  is amended by
 6    adding Section 31-5.5 as follows:

 7        (720 ILCS 5/31-5.5 new)
 8        Sec. 31-5.5.  Failure to report sexual assault or  sexual
 9    abuse.
10        (a)  A  person  who  witnesses  the  offense  of criminal
11    sexual assault, aggravated criminal sexual assault, predatory
12    criminal sexual assault of a child, criminal sexual abuse, or
13    aggravated criminal sexual abuse must report that offense  to
14    a  local  law  enforcement agency or peace officer as soon as
15    possible.  Reporting  under  this  subsection  (a)   includes
16    telephoning  a local emergency number such as 9-1-1 to report
17    the offense.
18        (b)  It is an affirmative defense to a violation of  this
19    Section  that  reporting  the  offense  would  jeopardize the
20    witness' life or physical safety.
21        (c)  Sentence.  A violation of this Section is a Class  A
22    misdemeanor  if  the victim at the time of the offense was at
23    least 13 years of age.  A violation  of  this  Section  is  a
24    Class  4  felony if the victim at the time of the offense was
25    under 13 years of age.
