1 AN ACT to amend the School Code by changing Section
2 2-3.76.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Section 2-3.76 as follows:
7 (105 ILCS 5/2-3.76) (from Ch. 122, par. 2-3.76)
8 Sec. 2-3.76. Ensure educational services provided to all
9 eligible children. The State Board of Education shall be the
10 State agency responsible for ensuring that educational
11 services are provided to all eligible children in Illinois.
12 This shall enhance the ability of the State Board to
13 guarantee that an appropriate education is made available to
14 each eligible child regardless of which agency places a child
15 or is responsible for its care and custody. In order to
16 fully implement this Section the State Board shall have the
17 authority to ensure that the educational programs provided by
18 the Department of Human Services and the Department of
19 Corrections, the educational components of the residential
20 schools operated by the Department of Human Services, and the
21 educational placements paid for by the Department of Children
22 and Family Services shall meet the standards of programs that
23 shall be provided to all eligible children.
