 1        AN  ACT  to  amend  the  School  Code by changing Section
 2    34-3.4.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  School  Code  is  amended  by changing
 6    Section 34-3.4 as follows:

 7        (105 ILCS 5/34-3.4)
 8        (Section scheduled to be repealed on June 30, 2000)
 9        Sec.  34-3.4.  Chicago  Schools  Academic  Accountability
10    Council.
11        (a)  The Chicago Schools Academic Accountability Council,
12    hereinafter in this Section referred  to  as  the  "Council",
13    shall  be  created  as provided in this Section to assist the
14    board and the  State  Board  of  Education  in  ensuring  the
15    continuous improvement in all schools operated by the board.
16        (b)  The  purpose  of  the  Council  is  to  develop  and
17    implement  a  comprehensive system of review, evaluation, and
18    analysis of school  performance  within  the  Chicago  public
19    schools.
20        (c)  The Trustees in consultation with the State Board of
21    Education   shall  establish  the  Chicago  Schools  Academic
22    Accountability Council to develop and implement an evaluation
23    system of the academic achievement of  schools  in  districts
24    having  a  population  that exceeds 500,000. The Trustees, in
25    consultation  with  the  State  Board  of  Education,   shall
26    determine  the  size  and makeup of the Council, the terms of
27    office of its  members,  and  the  process  for  appointment,
28    removal, and replacement of Council members. Evaluations will
29    be  provided  to the Trustees, the chief educational officer,
30    the  respective  principals,  the  respective  local   school
31    councils,   and   the   State  Superintendent  of  Education.

 1    Evaluations may make recommendations to support future school
 2    improvement, including recognition for exemplary achievement,
 3    and initiation of remediation,  probation,  intervention,  or
 4    closure   for  an  attendance  center  not  meeting  academic
 5    standards.  Consultation with the State  Board  of  Education
 6    shall  be directed at ensuring consistency of evaluations and
 7    preventing duplicative evaluation efforts.
 8        (d)  Nothing in this Section  is  designed  to  limit  or
 9    otherwise  affect  the general powers and responsibilities of
10    the chief educational officer to intervene or  otherwise  act
11    with  respect  to any attendance center not meeting standards
12    of academic performance  and  improvement  specified  by  the
13    board,  including intervention or action through remediation,
14    probation, intervention or closure.
15        (e)  The Trustees and the chief educational  officer  may
16    request  the Council to conduct or arrange for evaluations of
17    educational programs, policies,  and  procedures  as  may  be
18    deemed  necessary  to  ensure  the  academic  progress of the
19    attendance centers in the system.
20        (f)  The annual budget of the Council shall be determined
21    by the Trustees.  Revenues needed to support  the  operations
22    of  the  Council  may  be derived from any available sources,
23    including, but not limited to,  State  aid  received  by  the
24    board   that  was  previously  paid  to  the  School  Finance
25    Authority.  Revenues may also  be  derived  from  grants  and
26    other contributions from civic, business, and community-based
27    foundations and from other private sources.
28        (g)  The  Council  shall  be subject to the provisions of
29    the Open Meetings Act and the Freedom of Information Act. The
30    Council shall adopt and publicize a set of criteria that  the
31    Council  must  use to determine which teachers and principals
32    it reviews and investigates.
33        (h)  This Section is repealed on June 30, 2000.
