1 AN ACT to amend the School Construction Law by changing
2 Section 5-30.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Construction Law is amended by
6 changing Section 5-30 as follows:
7 (105 ILCS 230/5-30)
8 Sec. 5-30. Priority of school construction projects. The
9 State Board of Education shall develop standards for the
10 determination of priority needs concerning school
11 construction projects based upon approved district facilities
12 plans. Such standards shall call for prioritization based on
13 the degree of need and project type in the following order:
14 (1) Replacement or reconstruction of school buildings
15 destroyed or damaged by flood, tornado, fire, earthquake, or
16 other disasters, either man-made or produced by nature;
17 (2) Projects resulting from the consolidation of school
18 districts under Article 7A, 11A, 11B, or 11D of the School
19 Code, from the dissolution and annexation of a school
20 district under Article 7 of the School Code, or from the
21 joint operation of a high school under Section 10-22.22c of
22 the School Code, and involving the construction of a new high
23 school serving between 500 and 1,000 students, provided that
24 no district involved currently operates a high school serving
25 more than 500 students;
26 (3) (2) Projects designed to alleviate a shortage of
27 classrooms due to population growth or to replace aging
28 school buildings;
29 (4) (3) Projects resulting from interdistrict
30 reorganization of school districts contingent on local
31 referenda;

1 (5) (4) Replacement or reconstruction of school
2 facilities determined to be severe and continuing health or
3 life safety hazards;
4 (6) (5) Alterations necessary to provide accessibility
5 for qualified individuals with disabilities; and
6 (7) (6) Other unique solutions to facility needs.
