1 AN ACT to amend the Illinois Public Aid Code by adding
2 Section 10-26.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 adding Section 10-26 as follows:
7 (305 ILCS 5/10-26 new)
8 Sec. 10-26. Payment of interest on delay of transmitting
9 child support payments. The Department shall distribute the
10 child support payments collected on behalf of persons to whom
11 it furnishes child and spouse support services in accordance
12 with the priorities and time frames established by Title IV-D
13 of the federal Social Security Act and implementing
14 regulations. Notwithstanding any other provision of Illinois
15 law, if the Department is late in payment to a custodial
16 parent of the child support collected, the State shall pay
17 the interest penalty required by this Section to the
18 custodial parent. A payment is late for purposes of this
19 Section if it is not made or mailed to the custodial parent
20 within the time prescribed by federal law and regulations.
21 The interest penalty is 2% of any late amount for each month
22 or fraction thereof until payment is made. The Department of
23 Human Services shall disregard any interest paid pursuant to
24 this Section in determining eligibility for and the amount of
25 assistance under this Code.
