1 AN ACT to amend the Toll Highway Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Toll Highway Act is amended by changing
5 Section 3 as follows:
6 (605 ILCS 10/3) (from Ch. 121, par. 100-3)
7 Sec. 3. Illinois State Toll Highway Authority; creation;
8 appointments. There is hereby created an Authority to be
9 known as The Illinois State Toll Highway Authority, which is
10 hereby constituted an instrumentality and an administrative
11 agency of the State of Illinois. The said Authority shall
12 consist of 11 directors; the Governor and the Secretary of
13 the Department of Transportation, ex officio, and 9 directors
14 appointed by the Governor with the advice and consent of the
15 Senate, from the State at large, which said directors and
16 their successors are hereby authorized to carry out the
17 provisions of this Act, and to exercise the powers herein
18 conferred. Of the 9 directors appointed by the Governor, no
19 more than 5 shall be members of the same political party.
20 Vacancies shall be filled for the unexpired term in the same
21 manner as original appointments. All appointments shall be in
22 writing and filed with the Secretary of State as a public
23 record. It is the intention of this section that the
24 Governor's appointments shall be made with due consideration
25 to the location of proposed toll highway routes so that
26 maximum geographic representation from the areas served by
27 said toll highway routes may be accomplished insofar as
28 practicable. The said Authority shall have the power to
29 contract and be contracted with, to acquire, hold and convey
30 personal and real property or any interest therein including
31 rights of way, franchises and easements; to have and use a

1 common seal, and to alter the same at will; to make and
2 establish resolutions, by-laws, rules, rates and regulations,
3 and to alter or repeal the same as the Authority shall deem
4 necessary and expedient for the construction, operation,
5 relocation, regulation and maintenance of a system of toll
6 highways within and through the State of Illinois.
7 Appointment of the additional directors provided for by
8 this amendatory Act of 1980 shall be made within 30 days
9 after the effective date of this amendatory Act of 1980.
