 1        AN ACT to amend the  Public  Utilities  Act  by  changing
 2    Section 8-502.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.   The  Public  Utilities  Act  is  amended  by
 6    changing Section 8-502 as follows:

 7        (220 ILCS 5/8-502) (from Ch. 111 2/3, par. 8-502)
 8        Sec.  8-502.  Joint  use  of  facilities.   Whenever  the
 9    Commission,  after  a hearing had upon its own motion or upon
10    complaint, shall find that public convenience  and  necessity
11    require  the  use  by  one  public  utility  of the conduits,
12    subways, wires, poles, pipes or other property or  equipment,
13    or any part thereof, on, over or under any street or highway,
14    belonging  to  another public utility, and that such use will
15    not prevent the owner or other users thereof from  performing
16    their  public duties nor result in irreparable injury to such
17    owner or other users of such conduits, subways, wires, poles,
18    pipes or other property or equipment, or in  any  substantial
19    detriment to the service, and that such public utilities have
20    failed  to agree upon such use or the terms and conditions or
21    compensation for the same,  the  Commission  may,  by  order,
22    direct  that such use be permitted and prescribe a reasonable
23    compensation and reasonable terms  and  conditions  for  such
24    joint  use.  If  such  use be directed, the public utility to
25    whom the use is permitted shall be liable  to  the  owner  or
26    other users of such conduits, subways, wires, poles, pipes or
27    other  property  or  equipment, for such damage as may result
28    therefrom to the  property  of  such  owner  or  other  users
29    thereof.
