 1        AN  ACT  to  amend  the Criminal Code of 1961 by changing
 2    Section 11-15.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  Criminal  Code  of  1961 is amended by
 6    changing Section 11-15 as follows:

 7        (720 ILCS 5/11-15) (from Ch. 38, par. 11-15)
 8        Sec. 11-15. Soliciting for a prostitute.
 9        (a)  A Any person who performs any of the following  acts
10    commits soliciting for a prostitute:
11             (1)  Solicits    another    for   the   purpose   of
12        prostitution; or
13             (2)  Arranges or offers  to  arrange  a  meeting  of
14        persons for the purpose of prostitution; or
15             (3)  Directs   another   to  a  place  knowing  such
16        direction is for the purpose of prostitution.
17        (b)  Sentence.  Soliciting for a prostitute is a Class  A
18    misdemeanor.  A  person  convicted  of  a third or subsequent
19    violation of this Section, or  of  any  combination  of  such
20    number  of convictions under this Section and Sections 11-14,
21    11-17, 11-18, 11-18.1 and 11-19 of this Code shall be  guilty
22    of  a  Class  4  felony.   When  a person has 2 or more prior
23    convictions, the  information  or  indictment  charging  that
24    person  shall  state  such  prior  convictions  so as to give
25    notice of the State's intention to  treat  the  charge  as  a
26    felony.  The fact of such prior convictions is not an element
27    of  the  offense  and may not be disclosed to the jury during
28    trial unless otherwise permitted by  issues  properly  raised
29    during such trial.
