 1        AN  ACT to amend the Alternative Health Care Delivery Act
 2    by changing Section 55.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The Alternative Health Care Delivery Act is
 6    amended by changing Section 55 as follows:

 8        Sec. 55.   Hearings;  witnesses.  The  hearing  requested
 9    under  Sec.  50  shall  be  conducted  by  the Director or an
10    individual designated in writing by the Director as a hearing
11    officer. The Director  or  hearing  officer  may  compel,  by
12    subpoena   or   subpoena  duces  tecum,  the  attendance  and
13    testimony of  witnesses  and  the  production  of  books  and
14    papers.  The Director or hearing officer may administer oaths
15    to  witnesses.  The  hearing  shall  be  conducted at a place
16    designated  by  the  Department.   The  procedures  governing
17    hearings and the issuance of  final  orders  under  this  Act
18    shall  be  according  to rules adopted by the Department. All
19    subpoenas issued by the Director or hearing  officer  may  be
20    served  as  in  civil  actions.  The  fees  of  witnesses for
21    attendance and travel shall be  the  same  as  the  fees  for
22    witnesses  before  the circuit court and shall be paid by the
23    party to the proceedings at whose  request  the  subpoena  is
24    issued.  If  a  subpoena  is  issued  at  the  request of the
25    Department, the witness fee shall be paid by  the  Department
26    as an administrative expense.  If a witness refuses to attend
27    or  testify,  or  to  produce books or papers, concerning any
28    matter on which he or she might  be  lawfully  examined,  the
29    circuit  court of the county in which the hearing is held, on
30    application of  any  party  to  the  proceeding,  may  compel
31    obedience  by  a  proceeding  for  contempt  as in cases of a

 1    refusal to obey a similar order of the court.
