 1        AN  ACT  to  amend  the  Medical Practice Act by changing
 2    Section 25.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The Medical Practice Act of 1987 is amended
 6    by changing Section 25 as follows:

 7        (225 ILCS 60/25) (from Ch. 111, par. 4400-25)
 8        Sec.  25.  Summary  suspension.  The  Director   of   the
 9    Department  may, upon receipt of a written communication from
10    the Secretary of Human Services, the Director of Public  Aid,
11    or  the  Director  of  Public  Health  that  continuation  of
12    practice  of  a person licensed under this Act constitutes an
13    immediate danger to the public, and after  consultation  with
14    the  Chief Medical Coordinator or Deputy Medical Coordinator,
15    immediately suspend the license  of  such  person  without  a
16    hearing.   In  instances  in  which  the Director immediately
17    suspends a license under this Section, a  hearing  upon  such
18    person's  license  must be convened by the Disciplinary Board
19    within 15 days after such suspension  and  completed  without
20    appreciable  delay.   Such hearing is to be held to determine
21    whether to  recommend  to  the  Director  that  the  person's
22    license  be revoked, suspended, placed on probationary status
23    or reinstated, or whether such person should  be  subject  to
24    other  disciplinary  action.   In  the  hearing,  the written
25    communication and any other evidence submitted therewith  may
26    be  introduced  as  evidence  against  such  person; provided
27    however,  the  person,  or  their  counsel,  shall  have  the
28    opportunity  to  discredit,   impeach  and  submit   evidence
29    rebutting such evidence.
