 1        AN ACT to  amend  the  Environmental  Protection  Act  by
 2    changing Section 25b-5.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Environmental Protection Act  is  amended
 6    by changing Section 25b-5 as follows:

 7        (415 ILCS 5/25b-5) (from Ch. 111 1/2, par. 1025b-5)
 8        Sec. 25b-5. Community right-to-know reporting review. The
 9    Agency   shall   periodically  review  the  status  of  toxic
10    chemicals and types of facilities covered under the reporting
11    requirements of Section 313 of the federal Emergency Planning
12    and Community  Right-to-Know  Act  of  1986.   On  or  before
13    January  1,  1989,  and  after  providing  an opportunity for
14    public comment, the Agency shall submit  to  the  Governor  a
15    list  of toxic chemicals and facilities not currently covered
16    under that Act which it believes may pose a threat to  public
17    health  and  the  environment  in  Illinois.   Within 60 days
18    thereafter,  the   Governor   shall   either   petition   the
19    Administrator  of  the United States Environmental Protection
20    Agency to  modify  the  lists  of  chemicals  and  facilities
21    currently  covered  pursuant  to Section 313 according to the
22    Agency's recommendations, or refer the  matter  back  to  the
23    Agency  for  further  consideration  in  accordance  with his
24    written recommendations for change.
