1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 18c-7405.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 18c-7405 as follows:
7 (625 ILCS 5/18c-7405 new)
8 Sec. 18c-7405. After accident counseling.
9 (a) Every rail carrier shall provide or make counseling
10 or other critical incident stress debriefing services
11 available to each member of an operating crew involved in an
12 accident that results in loss of life or serious bodily
13 injury on its railway or right of way. If the engineer or
14 other operating crew member involved requests, he or she
15 shall be relieved from duty with compensation and applicable
16 benefits at the site of the accident, or within 48 hours of
17 the accident, for a minimum of 3 days.
18 (b) An engineer returning to duty following leave under
19 subsection (a) shall, if he or she so requests, be assigned
20 an assistant engineer or other qualified person who shall
21 accompany him or her for such time as may be necessary to
22 guarantee the public safety, or until an appropriate medical
23 practitioner has determined that the engineer does not suffer
24 from post-traumatic stress disorder.
25 (c) The Illinois Commerce Commission shall adopt rules
26 necessary for the implementation and enforcement of the
27 provisions of this Section.
28 (d) Nothing in this Section is intended to affect any
29 negotiated contract provision between employees and rail
30 carriers.
