 1        AN  ACT  to  amend  the  Metropolitan  Water  Reclamation
 2    District Act by changing Section 3.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Metropolitan Water Reclamation District
 6    Act is amended by changing Section 3 as follows:

 7        (70 ILCS 2605/3) (from Ch. 42, par. 322)
 8        Sec. 3.  Election of trustees.  The  corporate  authority
 9    of  the  Sanitary  District  of Chicago shall consist of nine
10    trustees.  Such trustees shall be elected for staggered terms
11    at the election provided by the general election law.   Three
12    trustees  shall  be  elected at each such election to succeed
13    the 3 trustees whose terms expire in such year.
14        Such trustees shall take  office  on  the  first  Tuesday
15    after  the  first  Monday in the month following the month of
16    their election and shall hold their offices for six years and
17    until their successors shall be elected and qualified. In all
18    elections for trustees each elector  may  vote  for  as  many
19    candidates  as  there  are  trustees  to  be  elected, but no
20    elector may give to such candidates more than  one  vote,  it
21    being  the  intent  and  purpose  of  this  Act  to  prohibit
22    cumulative voting in the selection of members of the board of
23    the sanitary district.
24        The  election of trustees shall be in accordance with the
25    provisions of the general election law.
26        By reason of the importance and character of the services
27    performed by the sanitary district, there is a great need and
28    it is in the public interest that such services be  performed
29    in as near a non-partisan character as possible.
30        When  a  vacancy  exists in the office of trustees of any
31    sanitary district organized under the provisions hereof,  the

 1    vacancy  shall be filled by appointment by the Governor until
 2    the next regular election at which trustees of  the  Sanitary
 3    District  of  Chicago  are  elected,  and  thereafter until a
 4    successor shall be elected and qualified.
 5        Such sanitary district shall from the time of  the  first
 6    election held by it under this Act be construed in all courts
 7    to be a body corporate and politic, and by the name and style
 8    of  the  sanitary district of...., and by such name and style
 9    may sue and be sued, contract and be contracted with, acquire
10    and hold real estate  and  personal  property  necessary  for
11    corporate  purposes,  and  adopt  a common seal and alter the
12    same at pleasure.
13        The board of trustees shall have the power to change  the
14    name  of  the  Sanitary  District of Chicago by ordinance and
15    public notice without impairing  the  legal  status  of  acts
16    theretofore  performed  by  said district. Thereafter any and
17    all references to the Sanitary District of  Chicago  in  this
18    Act  or otherwise shall mean and include the name under which
19    such sanitary district is then operating.  No rights,  duties
20    or  privilege  of  such  a sanitary district, or those of any
21    person, existing before the change of name shall be  affected
22    by  a  change,  in  the  name  of  a  sanitary district.  All
23    proceedings pending in any court in favor of or against  such
24    sanitary  district  may  continue to final consummation under
25    the name in which they were commenced.
