 1                     AMENDMENT TO HOUSE BILL 730

 2        AMENDMENT NO.     .  Amend House Bill  730  by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend  the  Criminal Code of 1961 by adding
 5    Section 31-5.5."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section  5.   The  Criminal  Code  of 1961 is amended by
 9    adding Section 31-5.5 as follows:

10        (720 ILCS 5/31-5.5 new)
11        Sec.  31-5.5.  Notification  to  peace  officer  of   the
12    commission of certain sex offenses at carnivals and fairs.
13        (a)  An  official  or  employee  of  an  operator  of  an
14    amusement  attraction,  carnival,  fair, or other place where
15    amusement rides are present who knows  or  reasonably  should
16    know  that  an  employee  of  the  operator  of the amusement
17    attraction, carnival, fair, or other  place  where  amusement
18    rides are present has committed an unlawful sex act against a
19    child  on the premises of the amusement attraction, carnival,
20    fair, or other place where amusement rides are present  shall
21    immediately  notify  local  law  enforcement officials of the

 1    occurrence of the unlawful sex act against a child.
 2        (b)  Sentence.  Failure to provide the notification to  a
 3    peace  officer  as  required  in  subsection (a) is a Class A
 4    misdemeanor.
 5        (c)  Definitions.  For purpose of this Section:
 6             (1)  "Amusement attraction", "carnival", "fair", and
 7        "operator" have the meanings ascribed to them in  Section
 8        2-2 of the Carnival and Amusement Rides Safety Act;
 9             (2)  "Child" meaning a person under 18 years of age;
10             (3)  "Unlawful  sex  act  against  a child" means an
11        offense described in Article 11 or Section 12-13,  12-14,
12        12-14.1,  12-15, or 12-16 of the Criminal Code of 1961 in
13        which the victim, at the time of the  commission  of  the
14        offense, is under 18 years of age.".
