 1        AN ACT concerning higher education, amending named Acts.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The University of Illinois Act is amended by
 5    adding Section 20 as follows:

 6        (110 ILCS 305/20 new)
 7        Sec. 20.  Part-time and nontenure-track faculty.
 8        (a)  The salary  of  the  part-time  and  nontenure-track
 9    faculty   shall   be  proportionate  to  the  salary  of  the
10    tenure-track  faculty.   In  this  Section,  "nontenure-track
11    faculty" includes without limitation instructors,  lecturers,
12    visiting assistant professors, and postdoctoral fellows.
13        (b)  Those members of the part-time faculty who work less
14    than 50% of the average work load of the tenure-track faculty
15    shall  receive  a minimum of 50% of the benefits available to
16    the tenure-track faculty.  Those  members  of  the  part-time
17    faculty  who work 50% or more of the average work load of the
18    tenure-track faculty  shall  receive  100%  of  the  benefits
19    available to the tenure-track faculty.

20        Section  10.  The Southern Illinois University Management
21    Act is amended by adding Section 10 as follows:

22        (110 ILCS 520/10 new)
23        Sec. 10.  Part-time and nontenure-track faculty.
24        (a)  In a given discipline, the salary of  the  part-time
25    and  nontenure-track  faculty  shall  be proportionate to the
26    salary  of  the  tenure-track  faculty.   In  this   Section,
27    "nontenure-track   faculty"   includes   without   limitation
28    instructors,  lecturers,  visiting  assistant professors, and
29    postdoctoral fellows.

 1        (b)  Those members of the part-time faculty who work less
 2    than 50% of the average work load of the tenure-track faculty
 3    shall receive a minimum of 50% of the benefits  available  to
 4    the  tenure-track  faculty.   Those  members of the part-time
 5    faculty who work 50% or more of the average work load of  the
 6    tenure-track  faculty  shall  receive  100%  of  the benefits
 7    available to the tenure-track faculty.

 8        Section 15.  The Chicago State University Law is  amended
 9    by adding Section 5-115 as follows:

11        Sec. 5-115.  Part-time and nontenure-track faculty.
12        (a)  In  a  given discipline, the salary of the part-time
13    and nontenure-track faculty shall  be  proportionate  to  the
14    salary   of  the  tenure-track  faculty.   In  this  Section,
15    "nontenure-track   faculty"   includes   without   limitation
16    instructors, lecturers, visiting  assistant  professors,  and
17    postdoctoral fellows.
18        (b)  Those members of the part-time faculty who work less
19    than 50% of the average work load of the tenure-track faculty
20    shall  receive  a minimum of 50% of the benefits available to
21    the tenure-track faculty.  Those  members  of  the  part-time
22    faculty  who work 50% or more of the average work load of the
23    tenure-track faculty  shall  receive  100%  of  the  benefits
24    available to the tenure-track faculty.

25        Section  20.  The  Eastern  Illinois  University  Law  is
26    amended by adding Section 10-115 as follows:

29        (a)  In  a  given discipline, the salary of the part-time
30    and nontenure-track faculty shall  be  proportionate  to  the

 3    instructors, lecturers, visiting  assistant  professors,  and

 6    than 50% of the average work load of the tenure-track faculty
 7    shall  receive  a minimum of 50% of the benefits available to
 8    the tenure-track faculty.  Those  members  of  the  part-time
 9    faculty  who work 50% or more of the average work load of the

11    available to the tenure-track faculty.

12        Section   25.  The  Governors  State  University  Law  is
13    amended by adding Section 15-115 as follows:

15        Sec. 15-115.  Part-time and nontenure-track faculty.
16        (a)  In a given discipline, the salary of  the  part-time
17    and  nontenure-track  faculty  shall  be proportionate to the
18    salary  of  the  tenure-track  faculty.   In  this   Section,
19    "nontenure-track   faculty"   includes   without   limitation
20    instructors,  lecturers,  visiting  assistant professors, and
21    postdoctoral fellows.
22        (b)  Those members of the part-time faculty who work less
23    than 50% of the average work load of the tenure-track faculty
24    shall receive a minimum of 50% of the benefits  available  to
25    the  tenure-track  faculty.   Those  members of the part-time
26    faculty who work 50% or more of the average work load of  the
27    tenure-track  faculty  shall  receive  100%  of  the benefits
28    available to the tenure-track faculty.

29        Section 30.  The Illinois State University Law is amended
30    by adding Section 20-120 as follows:

16        Section 35.  The Northeastern Illinois University Law  is
17    amended by adding Section 25-115 as follows:

20        (a)  In  a  given discipline, the salary of the part-time
21    and nontenure-track faculty shall  be  proportionate  to  the
22    salary   of  the  tenure-track  faculty.   In  this  Section,

24    instructors, lecturers, visiting  assistant  professors,  and
25    postdoctoral fellows.
26        (b)  Those members of the part-time faculty who work less

 1        Section  40.  The  Northern  Illinois  University  Law is
 2    amended by adding Section 30-125 as follows:

 3        (110 ILCS 685/30-125 new)
 4        Sec. 30-125.  Part-time and nontenure-track faculty.
 5        (a)  In a given discipline, the salary of  the  part-time
 6    and  nontenure-track  faculty  shall  be proportionate to the
 7    salary  of  the  tenure-track  faculty.   In  this   Section,
 8    "nontenure-track   faculty"   includes   without   limitation
 9    instructors,  lecturers,  visiting  assistant professors, and
10    postdoctoral fellows.
11        (b)  Those members of the part-time faculty who work less
12    than 50% of the average work load of the tenure-track faculty
13    shall receive a minimum of 50% of the benefits  available  to
14    the  tenure-track  faculty.   Those  members of the part-time
15    faculty who work 50% or more of the average work load of  the
16    tenure-track  faculty  shall  receive  100%  of  the benefits
17    available to the tenure-track faculty.

18        Section  45.  The  Western  Illinois  University  Law  is
19    amended by adding Section 35-120 as follows:

20        (110 ILCS 690/35-120 new)
21        Sec. 35-120.  Part-time and nontenure-track faculty.
22        (a)  In a given discipline, the salary of  the  part-time
23    and  nontenure-track  faculty  shall  be proportionate to the
24    salary  of  the  tenure-track  faculty.   In  this   Section,
25    "nontenure-track   faculty"   includes   without   limitation
26    instructors,  lecturers,  visiting  assistant professors, and
27    postdoctoral fellows.
28        (b)  Those members of the part-time faculty who work less
29    than 50% of the average work load of the tenure-track faculty
30    shall receive a minimum of 50% of the benefits  available  to
31    the  tenure-track  faculty.   Those  members of the part-time

 1    faculty who work 50% or more of the average work load of  the
 2    tenure-track  faculty  shall  receive  100%  of  the benefits
 3    available to the tenure-track faculty.

 4        Section 50.  The Public Community College Act is  amended
 5    by changing Sections 3-31 and 3-42 as follows:

 6        (110 ILCS 805/3-31) (from Ch. 122, par. 103-31)
 7        Sec.  3-31.   To provide for or participate in provisions
 8    for insurance protection and benefits for its  employees  and
 9    their  dependents,  including  but  not limited to retirement
10    annuities, medical, surgical and hospital benefits,  in  such
11    types and amounts as shall be determined by the board for the
12    purpose  of  aiding in securing and retaining the services of
13    competent employees. Such insurance  may  include  provisions
14    for  employees  and their dependents who rely on treatment by
15    spiritual means alone through prayer for  healing  in  accord
16    with  the  tenets  and practices of well-recognized religious
17    denominations.   Where   employee   participation   in   such
18    provisions is involved, the board may with the consent of the
19    employee  withhold  deductions  from  the  employee's  salary
20    necessary to defray the employee's share  of  such  insurance
21    cost.
22        For  purposes of this Section, the term "dependent" means
23    an employee's spouse and any unmarried child  (1)  under  the
24    age  of  19  years  including  (a) an adopted child and (b) a
25    step-child or recognized child who lives with the employee in
26    a regular parent-child relationship, or (2) under the age  of
27    23  who  is  enrolled as a fulltime student in any accredited
28    school, college or university.
29        Those members of the part-time faculty who work less than
30    50% of the average work  load  of  the  tenure-track  faculty
31    shall  receive  a minimum of 50% of the benefits available to
32    the tenure-track faculty.  Those  members  of  the  part-time

 1    faculty  who work 50% or more of the average work load of the
 2    tenure-track faculty  shall  receive  100%  of  the  benefits
 3    available to the tenure-track faculty.

 6        Sec.  3-42. To employ such personnel as may be needed, to
 7    establish policies governing their employment and  dismissal,
 8    and   to  fix  the  amount  of  their  compensation.  In  the
 9    employment,  establishment  of   policies   and   fixing   of
10    compensation  the board may make no discrimination on account
11    of sex, race, creed, color or national origin.
12        Residence  within  any  community  college  district   or
13    outside   any   community   college  district  shall  not  be
14    considered:
15             (a)  in determining whether to retain or not  retain
16        any  employee  of  a  community college employed prior to
17        July 1, 1977 or prior to the adoption  by  the  community
18        college board of a resolution making residency within the
19        community  college  district  of  some or all employees a
20        condition of employment, whichever is later;
21             (b)  in assigning,  promoting  or  transferring  any
22        employee  of a community college to an office or position
23        employed prior to July 1, 1977 or prior to  the  adoption
24        by  the  community  college  board of a resolution making
25        residency within the community college district  of  some
26        or  all employees a condition of employment, whichever is
27        later; or
28             (c)  in determining the salary or other compensation
29        of any employee of a community college.
30        In a given discipline, the salary of  the  part-time  and
31    nontenure-track  faculty shall be proportionate to the salary
32    of   the   tenure-track   faculty.     In    this    Section,
33    "nontenure-track   faculty"   includes   without   limitation

 4        Section 99.  Effective date.  This Act takes effect  upon
