 1        AN ACT to create the Contractor Reporting Act.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  1.   Short  title.  This Act may be cited as the
 5    Contractor Reporting Act.

 6        Section 5.  Definitions.  For purposes of this  Act,  the
 7    following  definitions  shall  have  the  following meanings,
 8    except where the context requires otherwise:
 9        "Contractor" means a person who offers to  undertake,  or
10    holds  himself  or herself out as being able to undertake, or
11    does undertake to alter,  add  to,  subtract  from,  improve,
12    enhance, or beautify any residential realty or construct. The
13    term   "contractor"   includes   a  subcontractor,  specialty
14    contractor, general engineering contractor, general  building
15    contractor,  or  specialty contractor who performs any of the
16    activities listed in this definition directly or  indirectly.
17    The  term "contractor" does not include a person who performs
18    any of the activities described in this definition in  10  or
19    more states.
20        "Lawsuit"  means  a  suit  in  which the contractor was a
21    defendant.

22        Section 10.  Previous businesses owned by contractor.   A
23    contractor  shall  provide the Office of the Attorney General
24    with a list of all contracting  businesses  that  were  owned
25    previously, in whole or in part, by the contractor.

26        Section  15.  Lawsuits; bankruptcies.  A contractor shall
27    provide the Office of the Attorney General with a copy of all
28    of the bankruptcies filed with respect to the contractor  and
29    any  of  the  businesses  listed  in Section 10. A contractor

 1    shall provide the Office of the Attorney General with a  copy
 2    of  all  lawsuits  filed within the last 10 years against the
 3    contractor  pertaining  to  his  or  her  activities   as   a
 4    contractor,  the disposition of each of those lawsuits, and a
 5    list of any businesses required under Section 10.

 6        Section 20.  Disclosure to public.   The  Office  of  the
 7    Attorney General shall compile the information supplied to it
 8    under  Sections 10 and 15 and make it available to the public
 9    upon request.  The  Office  of  the  Attorney  General  shall
10    provide  a  toll  free number to give this information to the
11    public upon request.
