91_HB0498eng HB0498 Engrossed LRB9101221RCks 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 17-23. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 17-23 as follows: 7 (720 ILCS 5/17-23 new) 8 Sec. 17-23. Counterfeit retail sales receipt and 9 Universal Price Code Label. 10 (a) A person who, with intent to defraud a merchant, 11 possesses, uses, transfers, makes, sells, reproduces, 12 tenders, or delivers a false, counterfeit, altered, or 13 simulated retail sales receipt or a Universal Price Code 14 Label is guilty of a Class 4 felony. 15 (b) A person who possesses more than one false, 16 counterfeit, altered, or simulated retail sales receipt or 17 more than one false, counterfeit, altered, or simulated 18 Universal Price Code Label or who possesses a device the 19 purpose of which is to manufacture false, counterfeit, 20 altered, or simulated retail sales receipts or Universal 21 Price Code Labels is guilty of a Class 3 felony. 22 (c) Definitions. In this Section: 23 "Universal Price Code Label" means a unique symbol that 24 consists of a machine readable code and human readable 25 numbers. 26 "Merchant" has the meaning ascribed to it in Section 27 16A-2.4 of this Code. 28 "Intent to defraud" has the meaning ascribed to it in 29 paragraph (iii) of subsection (A) of Section 17-1 of this 30 Code.
