1 AMENDMENT TO HOUSE BILL 379
2 AMENDMENT NO. . Amend House Bill 379 by replacing
3 the title with the following:
4 "AN ACT to amend the Illinois Propane Education and
5 Research Act of 1997 by changing Section 5."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Propane Education and Research
9 Act of 1997 is amended by changing Section 5 as follows:
10 (430 ILCS 27/5)
11 Sec. 5. Definitions. In this Act, unless the context
12 otherwise requires:
13 "Council" means a Propane Education and Research Council
14 created pursuant to Section 10 of this Act;
15 "Director" means Director of Agriculture or his or her
16 designee;
17 "Education" means any action to provide information
18 regarding propane, propane equipment, mechanical and
19 technical practices, and propane uses to consumers and
20 members of the propane industry;
21 "Industry" means those persons involved in the

1 production, transportation, and sale of propane, and the
2 manufacture and distribution of propane utilization
3 equipment;
4 "Industry trade association" means an organization exempt
5 from tax, under Section 501(c)(3), or (6) of the Internal
6 Revenue Code of 1986, representing the propane industry;
7 "Odorized propane" means propane which has an odorant
8 added to it;
9 "Placed into commerce" means delivered, transported for
10 storage, or sold within the State of Illinois;
11 "Producer" means the owner of propane at the time it is
12 recovered at a gas processing plant or refinery; irrespective
13 of the state where production occurs;
14 "Propane" means a hydrocarbon whose chemical composition
15 is predominately C3H8, whether recovered from natural gas or
16 crude oil, and includes liquified petroleum gases and
17 mixtures thereof;
18 "Public member" means a member of the Council other than
19 a representative of producers or retail marketers
20 representing significant users of propane, public safety
21 officials, state regulatory officials, or other groups
22 knowledgeable about propane;
23 "Qualified industry organization" means the Illinois
24 Propane Gas Association, the National Propane Gas
25 Association, the Gas Processors Association, a successor
26 association of these associations, or any other propane
27 industry organization;
28 "Research" means any type of study, investigation or
29 other activities designed to advance the image, desirability,
30 usage, marketability, efficiency, and safety of propane and
31 to further the development of such information;
32 "Retail marketer" means a person engaged primarily in the
33 sale of odorized propane to the ultimate consumer or to
34 retail propane dispensers; and

1 "Retail propane dispenser" means a person who sells
2 odorized propane to the ultimate consumer but is not engaged
3 primarily in the business of such sales.
