 1                     AMENDMENT TO HOUSE BILL 233

 2        AMENDMENT NO.     .  Amend House Bill 233 on page 1, line
 3    28, after "and", by inserting "inspectors and"; and

 4    on  page  2,  line  16,  after   "license.",   by   inserting
 5    ""Electrical  contractor" shall not include any manufacturing
 6    corporation that engages in the activities described in  this
 7    paragraph  incidental  to  operation  or  maintenance  of its
 8    existing business and facilities;  however,  a  manufacturing
 9    corporation that is involved in new construction that results
10    in  the  expansion of its existing business and facilities is
11    included in the definition of "electrical contractor."; and

12    on page 7, line 31, after "Act", by inserting "or an employee
13    of a manufacturing corporation  that  engages  in  activities
14    incidental  to  operation  or  maintenance  of  its  existing
15    business and facilities"; and

16    on  page  11,  by  replacing  lines  12  through  33 with the
17    following:
18        "(b) The Department  shall  provide  for  fees  by  rule;
19    however, the fees shall not exceed the following amounts:
20             (1)  the  application fee for a license or temporary
21        license, $100;
22             (2)  the fee for renewal of a license, $25;

 1             (3)  the fee for reinstatement of a license that has
 2        been expired for less than 2 years, $50 plus  payment  of
 3        all unpaid renewal fees;
 4             (4)  the  fee  for restoration of a license that has
 5        been expired for more than 2 years, $100;
 6             (5)  the fee for issuance of  a  duplicate  license,
 7        the  issuance  of  a  replacement  that  has been lost or
 8        destroyed, or the issuance of a license with a change  of
 9        name  and  address, other than during the renewal period,
10        $25;
11             (6)  the  fee  for  certification  of  a  licensee's
12        record for any purpose, $25;
13             (7)  the fee for rescoring of  an  examination,  the
14        cost  to the Department of rescoring the examination plus
15        any fees charged by the  applicable  testing  service  to
16        have the examination rescored;
17             (8)  the  fee  for  copies  of a license, the actual
18        cost of producing the copies;
19             (9)  the fee for a roster  of  persons  licensed  as
20        electricians, the actual cost of producing the roster;
21             (10)  the  fee  for  application for a license by an
22        electrician registered or  licensed  under  the  laws  of
23        another state, $100."; and

24    on page 12, by deleting lines 1 through 6; and

25    on   page  13,  line  28,  after  "Act.",  by  inserting  the
26    following:
27        "The decedent's representative may petition the board for
28    an extension of the 6 month period in the event he or she can
29    demonstrate undue hardship or  other  special  circumstances.
30    The  extension  may  be  granted at the recommendation of the
31    Board, subject to Department approval."; and

32    on page 14,  by  replacing  lines  16  through  32  with  the
33    following:

 1        "(a)  Employees of, or independent contractors performing
 2    work for, any electric utility or electric utility affiliate,
 3    or  communications  or railway utility or any electric system
 4    owned and operated by a  municipal  corporation  or  unit  of
 5    local government (notwithstanding any other provision of this
 6    Act),  electric  cooperative as defined in Section 3.4 of the
 7    Electric  Supplier  Act,  telephone   or   telecommunications
 8    cooperative  as  defined  in  Section  13-212  of  the Public
 9    Utilities Act, or a telephone company shall not  be  required
10    to hold a license under any of the following conditions:
11             (1)  While   performing   work   on   installations,
12        materials,   or  equipment  that  are  owned  or  leased,
13        operated, and  maintained  by  the  electric  utility  or
14        electric  utility  affiliate,  communications  or railway
15        utility,  electric  system  owned  and  operated   by   a
16        municipal   corporation  or  unit  of  local  government,
17        electric, telephone, or  telecommunications  cooperative,
18        or  telephone  company  in the exercise of its utility or
19        telephone function, and that (i) are used exclusively for
20        the     generation,     transformation,     distribution,
21        transmission, or metering of  electric  current,  or  the
22        operation  of  railway  signals,  or  the transmission of
23        intelligence and do not have as a principal function  the
24        consumption  or  use  of  electric  current by or for the
25        benefit of any person other than the electric utility  or
26        electric  utility  affiliate,  communications  or railway
27        utility,  electric  system  owned  and  operated   by   a
28        municipal   corporation  or  unit  of  local  government,
29        electric, telephone, or  telecommunications  cooperative,
30        or  telephone  company  and (ii) are generally accessible
31        only to employees of the  electric  utility  or  electric
32        utility  affiliate,  communications  or  railway utility,
33        electric  system  owned  and  operated  by  a   municipal
34        corporation   or  unit  of  local  government,  electric,

 1        telephone,   or   telecommunications   cooperative,    or
 2        telephone  company or persons acting under its control or
 3        direction."; and

 4    on page 15, by deleting lines 1 through 3; and

 5    on page 16, line 8, after "farm", by inserting "or his or her
 6    employees"; and

 7    on page 16, immediately  below  line  14,  by  inserting  the
 8    following:
 9        "(f)  This   Act  shall  not  include  persons  or  firms
10    licensed  as  private  alarm  contractors  or  private  alarm
11    contractor agencies as  defined  in  the  Private  Detective,
12    Private Alarm, Private Security and Locksmith Act of 1993.
13        (g)  This  Act  shall  not  apply  to  the  installation,
14    replacement,   service,  or  repair  of  household  products,
15    including but not  limited  to  audio  and  video  equipment,
16    appliances,  garbage disposals, fans, lights, and garage door
17    openers, by a business entity primarily engaged in the retail
18    sale of consumer products.
19        (h)  Nothing in this Act shall be construed  to  restrict
20    the  activities of an employee of a manufacturing corporation
21    to  engage  in  activities   incidental   to   operation   or
22    maintenance of its existing business and facilities; however,
23    provisions  of  this  Act  do  apply to new construction that
24    results  in  the  expansion  of  the  existing  business   or
25    facilities of a manufacturing corporation."; and

26    on  page  21,  by  replacing  lines  2  through  17  with the
27    following:
28             "(1)  When owned or leased, operated, and maintained
29        by any electric utility or  electric  utility  affiliate,
30        communications  or railway utility, electric system owned
31        and operated by a municipal corporation or unit of  local
32        government,  electric,  telephone,  or telecommunications

 1        cooperative, or telephone company in the exercise of  its
 2        utility or telephone function and that:
 3                  (A)  are  used  exclusively for the generation,
 4             transformation,   distribution,   transmission,   or
 5             metering  of  electric  current,  the  operation  of
 6             railway   signals,   or    the    transmission    of
 7             intelligence,   and  do  not  have  as  a  principal
 8             function the consumption or use of electric  current
 9             by  or  for the benefit of any person other than the
10             electric  utility  or  electric  utility  affiliate,
11             communications or railway utility,  electric  system
12             owned  and  operated  by  a municipal corporation or
13             unit of local government,  electric,  telephone,  or
14             telecommunications    cooperative,    or   telephone
15             company; and
16                  (B)  are generally accessible only to employees
17             of  the  electric  utility   or   electric   utility
18             affiliate,   communications   or   railway  utility,
19             electric system owned and operated  by  a  municipal
20             corporation  or  unit of local government, electric,
21             telephone,  or  telecommunications  cooperative,  or
22             telephone  company  or  persons  acting  under   its
23             control or direction."; and

24    on  page  21,  immediately  below  line  26, by inserting the
25    following:
26        "(k)  A  manufacturing  corporation   that   engages   in
27    activities  incidental  to  operation  or  maintenance of its
28    existing  business  and  facilities   is   not   subject   to
29    inspection;  however,  a  manufacturing  corporation  that is
30    involved in new construction that results in the expansion of
31    its existing business  or  facilities  shall  be  subject  to
32    inspection under this Act."; and

33    on  page  23,  line  29,  after  "experience",  by adding "as

 1    provided in Section 25 of this Act"; and

 2    on page 23, line 30, by replacing "January 1" with "July  1";
 3    and

 4    on  page 23, line 32, by replacing "January 1" with "July 1";
 5    and

 6    on page 24, line 7, by replacing "January 1" with  "July  1";
 7    and

 8    on  page  24, line 8, by replacing "January 1" with "July 1";
 9    and

10    on page 24, line 9, by replacing "master" with  "journeyman";
11    and

12    on  page  24,  immediately  below  line  31, by inserting the
13    following:

14        "Section 135.  Electrical  Safety  Standards  Fund.   The
15    Electrical Safety Standards Fund is created as a special fund
16    in  the  State  treasury.  All fees and fines collected under
17    this Act shall be deposited into the Fund.  All money in  the
18    Electrical  Safety  Standards  Fund  may  be used, subject to
19    appropriation, by the Department for  the  administration  of
20    this Act."; and

21    on  page  25,  immediately  below  line  6,  by inserting the
22    following:

23        "Section 197.  The State Finance Act is amended by adding
24    Section 5.490 as follows:

25        (30 ILCS 105/5.490 new)
26        Sec. 5.490.  The Electrical Safety Standards Fund."; and

27    on page 25, line 7, by replacing "January 1" with "July 1".
