1 AN ACT to amend the Mental Health and Developmental
2 Disabilities Code by changing Section 1-102.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Mental Health and Developmental
6 Disabilities Code is amended by changing Section 1-102 as
7 follows:
8 (405 ILCS 5/1-102) (from Ch. 91 1/2, par. 1-102)
9 Sec. 1-102. "Care and custody" means authorization to an
10 appropriate person, with his consent, to provide or arrange
11 for proper and adequate treatment of another person who is
12 subject to involuntary admission but does not include the
13 authority to require hospitalization of the recipient unless
14 that such authority is expressly granted by court order
15 pursuant to Article VII of Chapter III.
