 1        AN ACT concerning cemeteries.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Township  Code  is  amended  by  adding
 5    Sections 130-45 and 135-65 as follows:

 6        (60 ILCS 1/130-45 new)
 7        Sec.  130-45.  Transfer  of  funds.   When   a   township
 8    cemetery   district   takes   over  a  cemetery  or  cemetery
 9    authority,  the  care  fund  of  the  cemetery  or   cemetery
10    authority  shall  be  transferred  into the cemetery district
11    fund of the township cemetery district.

13        Sec. 135-65.  Transfer of funds.  When  a  multi-township
14    cemetery   district   takes   over  a  cemetery  or  cemetery
15    authority,  the  care  fund  of  the  cemetery  or   cemetery
16    authority  shall  be  transferred  into the cemetery district
17    fund of the multi-township cemetery district.

18        Section 10.  The Cemetery  Maintenance  District  Act  is
19    amended by adding Section 12 as follows:

20        (70 ILCS 105/12 new)
21        Sec. 12.  Transfer of funds.  When a cemetery maintenance
22    district  takes  over  a  cemetery or cemetery authority, the
23    care fund of the cemetery  or  cemetery  authority  shall  be
24    transferred  into  the  cemetery  maintenance district's care
25    fund.

26        Section 15.  The Cemetery Care Act is amended  by  adding
27    Section 25 as follows:

 1        (760 ILCS 100/25 new)
 2        Sec.   25.  Use  of  care  funds.   When  a  township  or
 3    multi-township cemetery district takes  over  a  cemetery  or
 4    cemetery  authority, the care fund and care fund expenditures
 5    continue to be subject to the provisions of this Act, and the
 6    township or multi-township cemetery district must continue to
 7    use the care fund exclusively for the care and maintenance of
 8    the cemetery in accordance with this Act.
