 1        AN ACT to  amend  the  Environmental  Protection  Act  by
 2    changing Section 9.2.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Environmental Protection Act  is  amended
 6    by changing Section 9.2 as follows:

 7        (415 ILCS 5/9.2) (from Ch. 111 1/2, par. 1009.2)
 8        Sec.  9.2.  Sulfur  dioxide  emission  standards; review;
 9    amendments.
10        (a)  The Agency shall review all Illinois sulfur  dioxide
11    emission  standards  for  existing fuel combustion stationary
12    emission  sources  located  within  the  Chicago,  St.  Louis
13    (Illinois), and  Peoria  major  metropolitan  areas  and,  if
14    appropriate following such review, propose amendments to such
15    standards  to the Board by July 1, 1980, or within 90 days of
16    receipt of the initial reports required pursuant  to  Section
17    6.1  of this Act, whichever is later.  The standards proposed
18    by the Agency  shall  be  designed  to  enhance  the  use  of
19    Illinois  coal,  consistent  with  the  need  to  attain  and
20    maintain  the  National  Ambient  Air  Quality  Standards for
21    sulfur dioxide and particulate matter.
22        (b)  In granting any  alternative  emission  standard  or
23    variance   relating   to  sulfur  dioxide  emissions  from  a
24    coal-burning stationary source, the Board may require the use
25    of Illinois coal as a condition of such alternative  standard
26    or variance, provided that the Board determines that Illinois
27    coal  of  the  proper quality is available and competitive in
28    price; such determination shall include consideration of  the
29    cost  of  pollution control equipment and the economic impact
30    on the Illinois coal mining industry.
