Amends the Sex Offender Registration Act. Provides that
it is unlawful for a sex offender to reside within 1,000 feet
of a school, child care facility, or day care center.
Effective 60 days after becoming law.

1 AN ACT to amend the Sex Offender Registration Act by
2 adding Section 13.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Sex Offender Registration Act is amended
6 by adding Section 13 as follows:
7 (730 ILCS 150/13 new)
8 Sec. 13. Sex offenders; prohibited residences near
9 schools, child care facilities, and day care centers.
10 (a) It is unlawful for a sex offender to reside within
11 1,000 feet of a school, child care facility, or day care
12 center.
13 (b) It is an affirmative defense to a violation of this
14 Section that the school, child care facility, or day care
15 center was not located within 1,000 feet of the residence of
16 the sex offender at the time the sex offender began to reside
17 at his or her residence upon sentencing or if confined upon
18 the sex offender's discharge from a penal institution,
19 hospital, or mental health facility.
20 (c) For purposes of this Section, "child care facility"
21 and "day care center" have the meanings ascribed to them in
22 the Child Care Act of 1969.
23 Section 99. Effective date. This Act takes effect 60
24 days after becoming law.
