1 AN ACT to amend the Code of Criminal Procedure of 1963 by
2 changing Section 103-8.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Code of Criminal Procedure of 1963 is
6 amended by changing Section 103-8 as follows:
7 (725 ILCS 5/103-8) (from Ch. 38, par. 103-8)
8 Sec. 103-8. Mandatory duty of officers.
9 Any peace officer who intentionally prevents the exercise
10 by an accused of any right conferred by this Article or who
11 intentionally fails to perform any act required of him or her
12 by this Article shall be guilty of official misconduct and
13 may be punished in accordance with Section 33-3 of the
14 "Criminal Code of 1961" approved July 28, 1961, as heretofore
15 and hereafter amended.
