      110 ILCS 805/3-26.2 new
          Amends  the  Public  Community  College  Act.    Requires
      community college boards to achieve a ratio between full-time
      faculty  members  and part-time teachers under which at least
      75% of all full-time equivalent teaching positions  are  held
      by  full-time  faculty  members  and not more than 25% of all
      full-time equivalent teaching positions are held by part-time
      teachers.  Provides for a phase-in that  begins  with  fiscal
      year  1998  and that requires a community college district to
      use 33% of the increase in its  annual  distribution  formula
      grants each fiscal year to achieve the required ratio between
      full-time and part-time teachers holding full-time equivalent
      teaching positions in the district.  Effective immediately.

 1        AN  ACT  to  amend  the  Public  Community College Act by
 2    adding Section 3-26.2.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Public Community College Act is amended
 6    by adding Section 3-26.2 as follows:
 7        (110 ILCS 805/3-26.2 new)
 8        Sec. 3-26.2. Full-time position requirements.
 9        (a)  In order to enhance the quality of community college
10    instruction and provide for a  more  equitable  treatment  of
11    community  college faculty members, it shall be the policy of
12    the State of Illinois that part-time  teachers  (i)  be  used
13    solely   to  supplement  and  not  to  replace  any  existing
14    full-time tenured or nontenured faculty member, and  (ii)  be
15    used  solely in those instances in which a full-time position
16    cannot be generated or  when  specialized  services  that  no
17    full-time  tenured  or nontenured faculty member is competent
18    to render are required.
19        (b)  Each community college board  shall  achieve,  on  a
20    phased-in  basis  as  provided  in  this  subsection, a ratio
21    between its full-time faculty members and part-time  teachers
22    under which at least 75% of all full-time equivalent teaching
23    positions  in  the  community  college  district  are held by
24    full-time faculty members  and  not  more  than  25%  of  all
25    full-time  equivalent  teaching  positions  in  the community
26    college district are held  by  part-time  teachers;  provided
27    that  this  subsection shall not be construed to prohibit job
28    sharing of full-time positions.
29        Beginning with fiscal year 1998, and in each fiscal  year
30    thereafter,  a community college district shall use and apply
31    not less than 33% of the amount by which the aggregate grants

 1    received by  the  district  under  Section  2-16.02  for  the
 2    current  fiscal  year exceed the aggregate grants received by
 3    the district under that Section for the immediately preceding
 4    fiscal  year  to  (i)  increase  the  number   of   full-time
 5    equivalent  teaching  positions in the district that are held
 6    by full-time faculty members and (ii) decrease the number  of
 7    full-time  equivalent teaching positions in the district that
 8    are held by part-time teachers.  The requirement of  using  a
 9    specified  percentage  of  each fiscal year's increase in the
10    aggregate grants  received  by  the  district  under  Section
11    2-16.02  shall  no longer apply to the district when at least
12    75% of those full-time equivalent teaching positions are held
13    by full-time faculty members and not more than 25%  of  those
14    full-time equivalent teaching positions are held by part-time
15    teachers.
16        (c)  The State Board shall promulgate all rules necessary
17    to administer and implement the provisions of this Section.
18        Section  99.  Effective date.  This Act takes effect upon
19    becoming law.
