      10 ILCS 5/29-14.5 new
          Amends the Election  Code.   Prohibits  any  person  from
      knowingly  publishing or broadcasting campaign materials that
      contain an altered or fraudulent picture.  Provides that  any
      candidate or political committee that publishes or broadcasts
      an altered or fraudulent picture shall be liable for the cost
      of  publishing  or broadcasting a public acknowledgement that
      the campaign materials were altered or  fraudulent,  and  the
      unaltered picture.

 1        AN  ACT  to  amend  the  Election  Code by adding Section
 2    29-14.5.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Election  Code  is  amended  by  adding
 6    Section 29-14.5 as follows:
 7        (10 ILCS 5/29-14.5 new)
 8        Sec.  29-14.5.  Publication  of  fraudulent pictures.  No
 9    person, during the course of any campaign for  nomination  or
10    election  to  public  office  or office of a political party,
11    shall knowingly distribute, publish,  or  broadcast  campaign
12    materials  that  contain  an  altered  or fraudulent picture.
13    Campaign materials shall include, but are not limited to, all
14    printed matter, television commercials, advertisements  in  a
15    newspaper or periodical, a public speech or press release, or
16    any   other   materials  for  distribution.   Candidates  are
17    responsible for the materials published or broadcast by their
18    political committees.   Nothing  contained  in  this  Section
19    shall  require  the  publisher of the advertisement to verify
20    the accuracy of the content provided by the advertiser.
21        Altered  or   fraudulent   pictures   are   those   which
22    substantially   alter   the  identity  of  an  individual  or
23    otherwise substantially alter  the  facts  contained  in  the
24    picture.
25        Any  person,  candidate  or political party that violates
26    this Section shall be liable for the  cost  of  distributing,
27    publishing, or broadcasting, in the same manner and degree as
28    the  original  distribution,  publication,  or  broadcast,  a
29    public   acknowledgment  that  the  campaign  materials  were
30    altered  or  fraudulent.   The  public  acknowledgment  shall
31    include the original unaltered picture.

 1        In addition to any other  penalties,  violation  of  this
 2    Section shall be a Class B misdemeanor.
