1 AN ACT to amend the Civil Administrative Code of Illinois
2 by changing Section 55.02.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Civil Administrative Code of Illinois is
6 amended by changing Section 55.02 as follows:
7 (20 ILCS 2310/55.02) (from Ch. 127, par. 55.02)
8 Sec. 55.02. General supervisory powers. To have the
9 general supervision of the interests of the health and lives
10 of the people of the State and to exercise the rights, powers
11 and duties of those Acts which it is by law authorized to
12 enforce. The Department shall have the general authority to
13 delegate to county and multiple-county boards of health the
14 duties under those Acts it is authorized to enforce for the
15 purpose of local administration and enforcement. Upon
16 accepting the delegation, county and multiple-county boards
17 of health shall administer and enforce the minimum program
18 standards promulgated by the Department under the provisions
19 of those Acts. County and multiple-county boards of health
20 may establish reasonable fees for the permits, licenses, or
21 other activities performed under the delegation agreement.
22 The Department may waive any portion of its fees established
23 by statute or rule if the county or multiple-county board of
24 health accepts the delegation.
