 1                    AMENDMENT TO HOUSE BILL 2469
 2        AMENDMENT NO.     .  Amend House Bill 2469,  AS  AMENDED,
 3    in  the  introductory  clause of Section 5, by replacing "and
 4    16F-3" with "16F-3, and 24-1.2"; and
 5    by inserting after the last line of Sec. 16F-3 of  Section  5
 6    the following:
 7        "(720 ILCS 5/24-1.2) (from Ch. 38, par. 24-1.2)
 8        Sec. 24-1.2.  Aggravated discharge of a firearm.
 9        (a)  A  person  commits aggravated discharge of a firearm
10    when he knowingly or intentionally:
11             (1)  Discharges a firearm at or into a  building  he
12        knows to be occupied and the firearm is discharged from a
13        place or position outside that building;
14             (2)  Discharges   a  firearm  in  the  direction  of
15        another person or in the direction of a vehicle he  knows
16        to be occupied;
17             (3)  Discharges  a  firearm  in  the  direction of a
18        person he knows to be a peace officer, a person  summoned
19        or   directed   by   a   peace  officer,  a  correctional
20        institution employee, or a  fireman  while  the  officer,
21        employee or fireman is engaged in the execution of any of
22        his  official duties, or to prevent the officer, employee

 1        or fireman from performing his  official  duties,  or  in
 2        retaliation   for   the   officer,  employee  or  fireman
 3        performing his official duties;
 4             (4)  Discharges a firearm  in  the  direction  of  a
 5        vehicle  he  knows  to  be occupied by a peace officer, a
 6        person  summoned  or  directed  by  a  peace  officer,  a
 7        correctional institution employee or a fireman while  the
 8        officer,  employee or fireman is engaged in the execution
 9        of any of his official duties, or to prevent the officer,
10        employee or fireman from performing his official  duties,
11        or  in  retaliation  for the officer, employee or fireman
12        performing his official duties;
13             (5)  Discharges a firearm  in  the  direction  of  a
14        person  he  knows to be an emergency medical technician -
15        ambulance, emergency medical technician  -  intermediate,
16        emergency   medical  technician  -  paramedic,  ambulance
17        driver,  or  other  medical  assistance  or   first   aid
18        personnel,   employed   by   a   municipality   or  other
19        governmental unit, while the emergency medical technician
20        - ambulance, emergency medical technician - intermediate,
21        emergency  medical  technician  -  paramedic,   ambulance
22        driver,   or   other  medical  assistance  or  first  aid
23        personnel is engaged in  the  execution  of  any  of  his
24        official  duties,  or  to  prevent  the emergency medical
25        technician - ambulance, emergency  medical  technician  -
26        intermediate,  emergency  medical technician - paramedic,
27        ambulance driver, or other medical  assistance  or  first
28        aid  personnel from performing his official duties, or in
29        retaliation  for  the  emergency  medical  technician   -
30        ambulance,  emergency  medical technician - intermediate,
31        emergency  medical  technician  -  paramedic,   ambulance
32        driver,   or   other  medical  assistance  or  first  aid
33        personnel performing his official duties; or
34             (6)  Discharges a firearm  in  the  direction  of  a

 1        vehicle  he  knows to be occupied by an emergency medical
 2        technician - ambulance, emergency  medical  technician  -
 3        intermediate,  emergency medical technician - paramedic,,
 4        ambulance driver, or other medical  assistance  or  first
 5        aid  personnel,  employed  by  a  municipality  or  other
 6        governmental unit, while the emergency medical technician
 7        - ambulance, emergency medical technician - intermediate,
 8        emergency   medical  technician  -  paramedic,  ambulance
 9        driver,  or  other  medical  assistance  or   first   aid
10        personnel  is  engaged  in  the  execution  of any of his
11        official duties, or  to  prevent  the  emergency  medical
12        technician  -  ambulance,  emergency medical technician -
13        intermediate, emergency medical technician  -  paramedic,
14        ambulance  driver,  or  other medical assistance or first
15        aid personnel from performing his official duties, or  in
16        retaliation   for  the  emergency  medical  technician  -
17        ambulance, emergency medical technician  -  intermediate,
18        emergency   medical  technician  -  paramedic,  ambulance
19        driver,  or  other  medical  assistance  or   first   aid
20        personnel performing his official duties.
21        (b)  A  violation   of  subsection (a) (1) or  subsection
22    (a) (2) of this Section is a Class 1 felony.  A violation  of
23    subsection  (a)(1)  or  (a)(2) of this Section committed in a
24    school  or  on  the  real  property  comprising   a   school,
25    regardless  of  the  time of the day or time of year that the
26    offense was committed, is a Class X felony.  A  violation  of
27    subsection  (a)  (3),  (a)  (4),  (a) (5), or (a) (6) of this
28    Section is a Class X felony for which the sentence shall be a
29    term of imprisonment of no less than 10 years  and  not  more
30    than 45 years.
31        (c)  For  purposes  of  this  Section, "school" means any
32    public or private elementary or secondary  school,  community
33    college, college, or university.

 1    by  inserting after the last line of Sec. 5-5-3 of Section 15
 2    the following:
 3        "Section  99.  Effective  date.   This  Section  and  the
 4    amendatory changes to Sec. 24-1.2 of  the  Criminal  Code  of
 5    1961 take effect upon becoming law.".
