 1                    AMENDMENT TO HOUSE BILL 2370
 2        AMENDMENT NO.     .  Amend House Bill 2370 as follows:
 3    on  page  1,  line  16,  after  "State",  by  inserting   the
 4    following:
 5    ", including a  home rule unit"; and
 6    on line 29, after "requirement", by inserting the following:
 7    "under   the   First      Amendment   to  the  United  States
 8    Constitution"; and
 9    on page 2, line 18, by replacing "local laws and  ordinances"
10    with the  following:
11    "local (including home rule unit) laws, ordinances, policies,
12    procedures,  practices, and governmental actions"; and
13    on page 3, line 8, after "Act", by inserting the following:
14    "; home rule powers"; and
15    by replacing lines 9 through 11 with the following:
16        "(a)  This  Act applies to all State and local (including
17    home rule unit)    laws,  ordinances,  policies,  procedures,
18    practices,    and    governmental    actions      and   their
19    implementation, whether statutory or otherwise and  whether";

 1    and
 2    below line 28, by inserting the following:
 3        "(d) The corporate authorities of a municipality or other
 4    unit  of  local  government  may enact ordinances, standards,
 5    rules, or regulations  that  protect  the  free  exercise  of
 6    religion in a manner or to an extent equal to or greater than
 7    the  protection  provided  in  this  Act.   If  an ordinance,
 8    standard, rule, or regulation enacted under the authority  of
 9    this  Section  or  under  the  authority  of  a unit of local
10    government's home rule powers prohibits, restricts,  narrows,
11    or  burdens  a  person's  exercise of religion or permits the
12    prohibition,  restriction,  narrowing,  or  burdening  of   a
13    person's  exercise  of  religion,  that  ordinance, standard,
14    rule, or regulation is void  and  unenforceable  as  to  that
15    person  if  it  (i)  is  not  in  furtherance of a compelling
16    governmental interest and (ii) is not the  least  restrictive
17    means   of   furthering  that  governmental  interest.   This
18    subsection is a limitation under subsection (i) of Section  6
19    of Article VII of the Illinois Constitution on the concurrent
20    exercise by home rule units of powers and functions exercised
21    by the State.".
