Amends the Livestock Management Facilities Act. Requires
that construction or expansion of a new facility of 500 or
greater animal units be approved by the county board or, if
the facility is or will be located within a municipality, by
the corporate authorities of the municipality.

1 AN ACT to amend the Livestock Management Facilities Act
2 by adding Section 12.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Livestock Management Facilities Act is
6 amended by adding Section 12 as follows:
7 (510 ILCS 77/12 new)
8 Sec. 12. County or municipal approval. After the
9 Pollution Control Board has adopted the final rules
10 authorized under this Act, no new facility as defined in
11 Section 10.45 of 500 or greater animal units that was being
12 constructed on or after the adoption of those rules and no
13 new facility as defined in Section 10.45 of 500 or greater
14 animal units that was being expanded on or after the adoption
15 of those rules may begin or continue construction, continue
16 expansion, or commence operations without first obtaining
17 approval from the county board of the county in which the
18 facility is or will be located or, if the facility is or will
19 be located within the corporate limits of a municipality,
20 from the corporate authorities of that municipality. A
21 county board or the corporate authorities of a municipality
22 may deny approval under this Section in order to prevent any
23 harm to the health of the residents of the county or
24 municipality, the economy of the county or municipality, or
25 the natural resources within the county or municipality.
