      720 ILCS 5/33B-3          from Ch. 38, par. 33B-3
          Amends the Criminal Code of  1961.   Adds  a  heading  to
      Section that provides that an offense for which the defendant
      was  released  because  of  a  pardon  granted  on account of
      innocence  shall  not  be  considered  for  the  purposes  of
      determining whether the defendant is a habitual criminal.

 1        AN ACT to amend the Criminal Code  of  1961  by  changing
 2    Section 33B-3.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Criminal  Code  of  1961  is  amended  by
 6    changing Section 33B-3 as follows:
 7        (720 ILCS 5/33B-3) (from Ch. 38, par. 33B-3)
 8        Sec.  33B-3.  Pardon.   If  the person so convicted shall
 9    show to the  satisfaction  of  the  court  before  whom  such
10    conviction  was  had  that he was released from imprisonment,
11    upon either of the sentences upon a pardon  granted  for  the
12    reason  that  he  was  innocent, such conviction and sentence
13    shall not be considered under Section 33B-1.
