      430 ILCS 65/9             from Ch. 38, par. 83-9
          Amends  the  Firearm  Owners  Identification  Card   Act.
      Provides  that  a person whose Firearm Owner's Identification
      Care is revoked by  the  Department  of  State  Police  shall
      return  the  revoked  card  to  the  Department  or submit an
      affidavit to the Department that his or  her  card  has  been
      lost  or  destroyed.   Provides that a knowing violation is a
      Class 4 felony.  Provides that the Department may attempt  to
      confiscate  revoked  cards  of  certain mentally ill persons.
      Effective immediately.

 1        AN ACT to amend the Firearm  Owners  Identification  Card
 2    Act by changing Section 9.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Firearm Owners Identification Card Act is
 6    amended by changing Section 9 as follows:
 7        (430 ILCS 65/9) (from Ch. 38, par. 83-9)
 8        Sec. 9. Notice of denial of application or revocation.
 9        (a)  Every person whose application for a Firearm Owner's
10    Identification Card is denied, and every  holder  of  such  a
11    card  before  his  card is revoked or seized, shall receive a
12    written notice from the Department of  State  Police  stating
13    specifically  the grounds upon which his application has been
14    denied  or  upon  which  his  Identification  Card  has  been
15    revoked.
16        (b)  Every person whose card is revoked by the Department
17    of  State  Police  shall  return  the  revoked  card  to  the
18    Department of State Police or  submit  an  affidavit  to  the
19    Department that his or her card has been destroyed or lost.
20        (c)  If the Department of State Police has revoked a card
21    because  the  holder  of  the  card has been a mental patient
22    within the last 5 years or whose  mental  condition  poses  a
23    clear and present danger, then the Department of State Police
24    shall attempt to confiscate that person's card.
25        (d)  Any  person who knowingly violates subsection (b) is
26    guilty of a Class 4 felony.

28        Section 99.  Effective date.  This Act takes effect  upon
29    becoming law.
