      New Act
      20 ILCS 415/4c            from Ch. 127, par. 63b104c
          Creates the Commission on the Status of Women and defines
      its powers and duties.  Provides that  the  Commission  shall
      study  the  status  of  women  in  the  State and make annual
      recommendations to the  Governor  and  General  Assembly  for
      constructive  legislation.   Amends  the  Personnel  Code  to
      exempt  from  its  provisions  employees  of  the Commission.

 1        AN ACT concerning a commission on the status of women.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  1.  Short  title.   This Act may be cited as the
 5    Commission on the Status of Women Act.
 6        Section    5.  Creation;    membership;     appointments;
 7    vacancies.  There  is  created  a Commission on the Status of
 8    Women consisting of 16 members: 4 members  of  the  House  of
 9    Representatives to be appointed 2 by the Speaker of the House
10    and  2  by the Minority Leader of the House, 4 members of the
11    Senate to be appointed 2 by the President of the Senate and 2
12    by the Minority Leader of the Senate, and 8  members  of  the
13    public  to  be  appointed,  2 each, by the Speaker and by the
14    Minority Leader of the House of Representatives  and  by  the
15    President  and  by  the  Minority  Leader  of the Senate. The
16    members of the Commission shall be appointed  biennially  for
17    terms expiring on July 1 of each succeeding odd-numbered year
18    and   shall  serve  until  their  respective  successors  are
19    appointed and qualified, except that General Assembly members
20    shall serve until their respective successors  are  appointed
21    or  until termination of their legislative service, whichever
22    first occurs.  The members of the Commission shall receive no
23    compensation for their services but shall be  reimbursed  for
24    necessary  expenses  incurred  in  the  performance  of their
25    duties.  Vacancies occurring because of death or  resignation
26    shall  be filled by the appointing authority for the group in
27    which the vacancy occurs.
28        Section   10.  Organization;   rules;    employees    and
29    assistants;  offices.  The  Commission  shall  within 30 days
30    after its appointment organize by appointing  one  member  as

 1    its  Chairperson  and  by  making  necessary  rules  for  the
 2    administration  of  the  Commission that are not inconsistent
 3    with this Act. The Commission may from  time  to  time  amend
 4    these rules.
 5        The  Commission may employ those employees and assistants
 6    as it deems necessary without regard to the Personnel Code or
 7    any other law of this State concerning State employment.  The
 8    employees  and  assistants  of  the   Commission   shall   be
 9    reimbursed  for  all  actual and necessary traveling expenses
10    and disbursements incurred by them in the discharge of  their
11    official duties.
12        The  Commission  shall  maintain an office or offices for
13    the transaction of its business in any city or cities in  the
14    State  of  Illinois that the Commission may designate and may
15    incur  the   necessary   expenses   for   office   furniture,
16    stationery, printing, and other incidental necessities.
17        Section   15.  Nine   members  of  the  Commission  shall
18    constitute a quorum for the transaction of business, and  the
19    concurrence of at least 8 Commissioners shall be necessary to
20    render a decision by the Commission.
21        Section  20.  Studies and recommendations. The Commission
22    shall study the status  of  women  in  this  State  and  make
23    recommendations  for  constructive  action  in  the following
24    areas:
25        (1)  Employment policies and practices.
26        (2)  Illinois Labor laws.
27        (3)  Legal rights.
28        (4)  The family and the employed woman.
29        (5)  Expanded programs to help women as  wives,  mothers,
30    and workers.
31        (6)  Women as citizen volunteers.
32        (7)  Education.

 1        In  addition,  the Commission shall study and analyze all
 2    facts relating to Illinois laws, regulations, and  guidelines
 3    with   respect   to   equal  protection  under  the  Illinois
 4    Constitution.
 5        The Commission may survey activity in  the  area  of  the
 6    status  of  women  carried  on  by any commission, agency, or
 7    department of the federal government or State or any  private
 8    entity  and  may  cooperate with these entities in conducting
 9    investigations and studies.
10        Section 25.  Gifts and grants. The Commission may  accept
11    monetary  gifts  or grants from the federal government or its
12    agencies, from  any  charitable  foundation  or  professional
13    association,  or  from  any  other  reputable  source for the
14    implementation of any  program  necessary  or  desirable  for
15    carrying  out  the general purposes of the Commission.  Gifts
16    and grants may  be  held  in  trust  by  the  Commission  and
17    expended in the exercise of its powers and performance of its
18    duties as prescribed by law.
19        Section  30.  Reports  and  recommendations. On or before
20    February 1 in each year, the Commission  shall  make  to  the
21    Governor and members of the General Assembly a full report of
22    its  proceedings  for the year ending the 1st day of December
23    in each year and may submit with the  report  recommendations
24    concerning  the  activities  of the Commission, together with
25    recommendations for legislative consideration and action.
26        The requirement for reporting  to  the  General  Assembly
27    shall  be  satisfied  by filing copies of the report with the
28    Speaker, the Minority Leader, and the Clerk of the  House  of
29    Representatives  and  the President, the Minority Leader, and
30    the Secretary of the Senate,  and  the  Legislative  Research
31    Unit,  as  required  by  Section  3.1 of the General Assembly
32    Organization Act, and filing additional copies with the State

 1    Government  Report  Distribution  Center  for   the   General
 2    Assembly  as is required under Section 7 of the State Library
 3    Act.
 4        Section  105.  The Personnel Code is amended by  changing
 5    Section 4c as follows:
 6        (20 ILCS 415/4c) (from Ch. 127, par. 63b104c)
 7        Sec. 4c.  General exemptions.  The following positions in
 8    State service shall be exempt from jurisdictions A, B, and C,
 9    unless  the  jurisdictions  shall  be extended as provided in
10    this Act:
11        (1)  All officers elected by the people.
12        (2)  All  positions  under   the   Lieutenant   Governor,
13    Secretary of State, State Treasurer, State Comptroller, State
14    Board of Education, Clerk of the Supreme Court, and  Attorney
15    General.
16        (3)  Judges,  and  officers  and employees of the courts,
17    and notaries public.
18        (4)  All officers and employees of the  Illinois  General
19    Assembly,  all  employees  of  legislative  commissions,  all
20    officers and employees of  the Illinois Legislative Reference
21    Bureau,  the  Legislative  Research Unit, and the Legislative
22    Printing Unit.
23        (5)  All positions in the Illinois National  Guard,   and
24    Illinois State Guard, paid from federal funds or positions in
25    the  State   Military  Service  filled by enlistment and paid
26    from State funds.
27        (6)  All employees  of  the  Governor  at  the  executive
28    mansion and on his immediate personal staff.
29        (7)  Directors  of Departments, the Adjutant General, the
30    Assistant Adjutant General,  the  Director  of  the  Illinois
31    Emergency   Management   Agency,   members   of   boards  and
32    commissions,   and  all  other  positions  appointed  by  the

 1    Governor by and with the consent of the Senate.
 2        (8)  The  presidents,  other   principal   administrative
 3    officers,  and  teaching, research and extension faculties of
 4    Chicago  State  University,  Eastern   Illinois   University,
 5    Governors   State   University,  Illinois  State  University,
 6    Northeastern   Illinois   University,    Northern    Illinois
 7    University,   Western   Illinois   University,  the  Illinois
 8    Community  College  Board,  Southern   Illinois   University,
 9    Illinois  Board  of Higher Education, University of Illinois,
10    State   Universities   Civil   Service   System,   University
11    Retirement  System  of  Illinois,  and   the   administrative
12    officers  and  scientific and technical staff of the Illinois
13    State Museum.
14        (9)  All other employees  except  the  presidents,  other
15    principal administrative officers, and teaching, research and
16    extension   faculties   of   the   universities   under   the
17    jurisdiction  of  the  Board  of Regents and the colleges and
18    universities  under  the   jurisdiction  of  the   Board   of
19    Governors   of  State  Colleges  and  Universities,  Illinois
20    Community  College  Board,  Southern   Illinois   University,
21    Illinois  Board  of  Higher  Education, Board of Governors of
22    State  Colleges  and  Universities,  the  Board  of  Regents,
23    University  of Illinois,  State  Universities  Civil  Service
24    System,  University Retirement System of Illinois, so long as
25    these are subject to the provisions of the State Universities
26    Civil Service Act.
27        (10)  The State Police so long as they are subject to the
28    merit provisions of the State Police Act.
29        (11)  The  scientific  staff  of  the  State   Scientific
30    Surveys  and  the  Hazardous  Waste  Research and Information
31    Center.
32        (12)  The  technical  and  engineering  staffs   of   the
33    Department  of  Transportation,  the  Department  of  Nuclear
34    Safety  and  of  the  Illinois  Commerce  Commission, and the

 1    technical and engineering staff providing  architectural  and
 2    engineering  services in the Department of Central Management
 3    Services.
 4        (13)  All employees of the Illinois  State  Toll  Highway
 5    Commission.
 6        (14)  The Secretary of the Industrial Commission.
 7        (15)  All  persons  who  are appointed or employed by the
 8    Director of Insurance  under authority of Section 202 of  the
 9    Illinois  Insurance Code to assist the Director  of Insurance
10    in  discharging  his   responsibilities   relating   to   the
11    rehabilitation, liquidation, conservation, and dissolution of
12    companies  that  are  subject  to  the  jurisdiction  of  the
13    Illinois  Insurance Code.
14        (16)  All  employees  of  the St. Louis Metropolitan Area
15    Airport Authority.
16        (17)  All investment officers employed  by  the  Illinois
17    State Board of Investment.
18        (18)  Employees  of the Illinois Young Adult Conservation
19    Corps program, administered by  the  Illinois  Department  of
20    Natural Resources, authorized grantee under Title VIII of the
21    "Comprehensive  Employment  and Training Act of 1973", 29 USC
22    993.
23        (19)  Seasonal employees of the Department of Agriculture
24    for the operation of the Illinois State Fair and the  DuQuoin
25    State Fair, no one person receiving more than 29 days of such
26    employment in any calendar year.
27        (20)  All   "temporary"   employees   hired   under   the
28    Department   of   Natural  Resources'  Illinois  Conservation
29    Service, a youth employment program that hires  young  people
30    to work in State parks for a period of one year or less.
31        (21)  All   hearing   officers   of   the   Human  Rights
32    Commission.
33        (22)  All  employees  of  the  Illinois  Mathematics  and
34    Science Academy.

 1        (23)  All employees of the  Kankakee  River  Valley  Area
 2    Airport Authority.
 3        (24)  All  employees  and assistants of the Commission on
 4    the Status of Women.

 6        Section 999.  Effective date.  This Act takes effect upon
 7    becoming law.
