          Amends the  Illinois  Food,  Drug  and  Cosmetic  Act  to
      prohibit  the  retail sale of professional hair care products
      to a person who is not a licensed barber or cosmetologist.

 1        AN ACT to amend the Illinois Food, Drug and Cosmetic  Act
 2    by  changing  Sections  2  and 3 and adding Sections 2.40 and
 3    3.23.
 4        Be it enacted by the People of  the  State  of  Illinois,
 5    represented in the General Assembly:
 6        Section  5.   The Illinois Food, Drug and Cosmetic Act is
 7    amended by changing Sections 2 and 3 and adding Sections 2.40
 8    and 3.23 as follows:
 9        (410 ILCS 620/2) (from Ch. 56 1/2, par. 502)
10        Sec.  2.   In  this  Act  unless  the  context  otherwise
11    requires, the words  and  phrases  defined  in  Sections  2.1
12    through 2.40 2.37, have the meanings set forth therein.

15        Sec.  2.40.   "Professional  hair  care product" means an
16    article intended to alter the appearance or  shape  of  human
17    hair that is labeled "for professional use only".

19        Sec. 3.  The enumerated acts in Sections 3.1 through 3.21
20    and in Section 3.23 and the causing thereof are prohibited in
21    this State.

24        Sec.  3.23.   The retail sale of a professional hair care
25    product  to  a  person  who  is  not  a  licensed  barber  or
26    cosmetologist under the Barber, Cosmetology,  Esthetics,  and
27    Nail Technology Act of 1985.
