    Sec. 1. Short title. This Act may be cited as the Topical Eye Medication Prescription Act.

    Sec. 5. Coverage. Every insurer that amends, delivers, issues, or renews an individual or group policy of accident and health insurance in this State that provides coverage for prescription topical eye medication shall not deny coverage for the refilling of a prescription for topical eye medication when:
        (1) the medication is to treat a chronic condition of
    
the eye;
        (2) the refill is requested by the insured prior to
    
the last day of the prescribed dosage period and after at least 75% of the predicted days of use; and
        (3) the prescribing physician licensed to practice
    
medicine in all its branches or optometrist indicates on the original prescription that refills are permitted and that the early refills requested by the insured do not exceed the total number of refills prescribed.
