Sec. 8.
Exemptions.
(a) This Act does not apply to any drug,
cosmetic, medical device or biological product which is intended for human
use and regulated under the Federal Food, Drug and Cosmetic Act, 21 USC 301,
et seq., as now or hereafter amended or under 42 USC 262, as now or hereafter
amended.
(b) A reviewing department may waive part or all of the requirements
under Section 3 for a specified regulated release if the reviewing
Department determines that the satisfaction of that requirement is not
necessary to protect the public health or the environment.
(c) A reviewing Department may exempt a class of regulated releases from
part or all of a requirement under Section 3 if the Department determines
that the satisfaction of that requirement or part thereof is not
necessary to protect the public health or the environment.
