    Amends the Board of Higher Education Act. Makes a technical change in a Section concerning gender equity in intercollegiate athletics.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5changing Section 9.24 as follows:
 
6    (110 ILCS 205/9.24)
7    Sec. 9.24. Sports Equity in Intercollegiate Athletics. For
8the the purpose of attaining gender equity in intercollegiate
9athletics, public institutions of higher education may grant,
10in addition to any such amounts previously authorized by the
11Board, tuition waivers in an amount not to exceed 1% of all
12tuition income. Intercollegiate athletics, for purposes of
13this Section, shall include only those sports sanctioned by the
14National Collegiate Athletic Association and the National
15Association of Intercollegiate Athletics, but shall not
16include club sports.
17    Before issuing any such tuition waiver, public
18institutions of higher education shall place on file with the
19Board a plan for achieving gender equity in intercollegiate
20athletics. The plan shall include, but not be limited to:
21        (1) intercollegiate sports opportunities available to
22    both men and women;
23        (2) activities to be undertaken by the institution to

1    achieve gender equity in intercollegiate athletics;
2        (3) identification of the barriers to achieving and
3    maintaining equitable intercollegiate athletic
4    opportunities for men and women;
5        (4) progress in achieving sports equity in compliance
6    with Title IX of the Education Amendments of 1972; and
7        (5) the use of tuition waivers for attaining gender
8    equity in intercollegiate sports.
9    The Board shall report every 3 years to the General
10Assembly and the Governor, on or before the second Wednesday of
11April, beginning in 2002, with a description of the plans
12submitted by each public institution of higher education
13relative to attainment of gender equity in intercollegiate
14sports. The report shall include financial data on tuition
15waivers and other intercollegiate athletic expenditures for
16men and women, the effectiveness of the plans, and the degree
17of compliance with Title IX of the Higher Education Act of
181965.
