1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Dangerous Animals Act is amended by
5 changing Sections 0.1 and 1 as follows:
 
6     (720 ILCS 585/0.1)  (from Ch. 8, par. 240)
7     Sec. 0.1. Definitions. As used in this Act, unless the
8 context otherwise requires:
9     "Dangerous animal" means a lion, tiger, leopard, ocelot,
10 jaguar, cheetah, margay, mountain lion, lynx, bobcat,
11 jaguarundi, bear, hyena, wolf or coyote, or any poisonous or
12 life-threatening reptile.
13     "Owner" means any person who (a) has a right of property in
14 a dangerous animal or primate, (b) keeps or harbors a dangerous
15 animal or primate, (c) has a dangerous animal or primate in his
16 care, or (d) acts as custodian of a dangerous animal or
17 primate.
18     "Person" means any individual, firm, association,
19 partnership, corporation, or other legal entity, any public or
20 private institution, the State of Illinois, or any municipal
21 corporation or political subdivision of the State.
22     "Primate" means a nonhuman member of the order primate,
23 including but not limited to chimpanzee, gorilla, orangutan,

1 bonobo, gibbon, monkey, lemur, loris, aye-aye, and tarsier.

4     Sec. 1. Dangerous animals and primates; prohibitions.
5     (a) No person shall have a right of property in, keep,
6 harbor, care for, act as custodian of or maintain in his
7 possession any dangerous animal or primate except at a properly
8 maintained zoological park, federally licensed exhibit,
9 circus, college or university, scientific or educational
10 institution, research laboratory, veterinary hospital, hound
11 running area, or animal refuge in an escape-proof enclosure.
12     (b) This Section does not prohibit a person who had lawful
13 possession of a primate before January 1, 2011, from continuing
14 to possess that primate if the person registers the animal by
15 providing written notification to the local animal control
16 administrator on or before April 1, 2011. The notification
17 shall include:
18         (1) the person's name, address, and telephone number;
19     and
20         (2) the type of primate, the age, a photograph, a
21     description of any tattoo, microchip, or other identifying
22     information, and a list of current inoculations.
23     (c) A person who registers a primate shall notify the local
24 animal control administrator within 30 days of a change of
25 address. If the person moves to another locality within the

1 State, the person shall register the primate with the new local
2 animal control administrator within 30 days of moving by
3 providing written notification as provided in subsection (b)
4 and shall include proof of the prior registration.
5     (d) A person who registers a primate shall notify the local
6 animal control administrator immediately if the primate dies,
7 escapes, or bites, scratches, or injures a person.
8     (e) This Section does not prohibit a person who is
9 permanently disabled with a severe mobility impairment from
10 possessing a single capuchin monkey to assist the person in
11 performing daily tasks if:
12         (1) the capuchin monkey was obtained from and trained
13     at a licensed nonprofit organization described in Section
14     501(c)(3) of the Internal Revenue Code of 1986, the
15     nonprofit tax status of which was obtained on the basis of
16     a mission to improve the quality of life of severely
17     mobility-impaired individuals; and
18         (2) the person complies with the notification
19     requirements as described in subsection (b).
