AMENDMENT TO SENATE BILL 3098

2    AMENDMENT NO. ______. Amend Senate Bill 3098 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by changing Section
62605-595 as follows:
 
7    (20 ILCS 2605/2605-595)
8    Sec. 2605-595. State Police Firearm Services Fund.
9    (a) There is created in the State treasury a special fund
10known as the State Police Firearm Services Fund. The Fund shall
11receive revenue under the Firearm Concealed Carry Act, the
12Firearm Dealer License Certification Act, and Section 5 of the
13Firearm Owners Identification Card Act. The Fund may also
14receive revenue from grants, pass-through grants, donations,
15appropriations, and any other legal source.
16    (a-5) Notwithstanding any other provision of law to the

1contrary, and in addition to any other transfers that may be
2provided by law, on the effective date of this amendatory Act
3of the 101st General Assembly, or as soon thereafter as
4practical, the State Comptroller shall direct and the State
5Treasurer shall transfer the remaining balance from the Firearm
6Dealer License Certification Fund into the State Police Firearm
7Services Fund. Upon completion of the transfer, the Firearm
8Dealer License Certification Fund is dissolved, and any future
9deposits due to that Fund and any outstanding obligations or
10liabilities of that Fund shall pass to the State Police Firearm
11Services Fund.
12    (b) The Department of State Police may use moneys in the
13Fund to finance any of its lawful purposes, mandates,
14functions, and duties under the Firearm Owners Identification
15Card Act, the Firearm Dealer License Certification Act, and the
16Firearm Concealed Carry Act, including the cost of sending
17notices of expiration of Firearm Owner's Identification Cards,
18concealed carry licenses, the prompt and efficient processing
19of applications under the Firearm Owners Identification Card
20Act and the Firearm Concealed Carry Act, the improved
21efficiency and reporting of the LEADS and federal NICS law
22enforcement data systems, and support for investigations
23required under these Acts and law. Any surplus funds beyond
24what is needed to comply with the aforementioned purposes shall
25be used by the Department to improve the Law Enforcement
26Agencies Data System (LEADS) and criminal history background

2    (c) Investment income that is attributable to the
3investment of moneys in the Fund shall be retained in the Fund
4for the uses specified in this Section.

6    Section 10. The State Finance Act is amended by changing
7Sections 5.664 and 5.892 as follows:

9    Sec. 5.664. The State Police Vehicle Maintenance Fund. This
10Fund is dissolved upon the transfer of the remaining balance
11from the State Police Vehicle Maintenance Fund to the State
12Police Vehicle Fund as provided under subsection (b) of Section
137c of the State Property Control Act. This Section is repealed
14on January 1, 2022.

17    Sec. 5.892. The Firearm Dealer License Certification Fund.
18This Fund is dissolved upon the transfer of the remaining
19balance from the Firearm Dealer License Certification Fund to
20the State Police Firearm Services Fund as provided under
21subsection (a-5) of Section 2605-595 of the Department of State
22Police Law of the Civil Administrative Code of Illinois. This
23Section is repealed on January 1, 2022.

2    Section 15. The State Property Control Act is amended by
3changing Sections 7b and 7c as follows:
 
4    (30 ILCS 605/7b)
5    Sec. 7b. Maintenance and operation of State Police
6vehicles. All proceeds received by the Department of Central
7Management Services under this Act from the sale of vehicles
8operated by the Department of State Police, except for a $500
9handling fee to be retained by the Department of Central
10Management Services for each vehicle sold, shall be deposited
11into the State Police Vehicle Fund State Police Vehicle
12Maintenance Fund. However, in lieu of the $500 handling fee as
13provided by this paragraph, the Department of Central
14Management Services shall retain all proceeds from the sale of
15any vehicle for which $500 or a lesser amount is collected.
16    The State Police Vehicle Maintenance Fund is created as a
17special fund in the State treasury. All moneys in the State
18Police Vehicle Maintenance Fund, subject to appropriation,
19shall be used by the Department of State Police for the
20maintenance and operation of vehicles for that Department.

23    Sec. 7c. Acquisition of State Police vehicles.

1    (a) The State Police Vehicle Fund is created as a special
2fund in the State treasury. All moneys in the Fund, subject to
3appropriation, shall be used by the Department of State Police:
4        (1) for the acquisition of vehicles for that
5    Department; or
6        (2) for debt service on bonds issued to finance the
7    acquisition of vehicles for that Department; or .
8        (3) for the maintenance and operation of vehicles for
9    that Department.
10    (b) Notwithstanding any other provision of law to the
11contrary, and in addition to any other transfers that may be
12provided by law, on the effective date of this amendatory Act
13of the 101st General Assembly, or as soon thereafter as
14practicable, the State Comptroller shall direct and the State
15Treasurer shall transfer the remaining balance from the State
16Police Vehicle Maintenance Fund into the State Police Vehicle
17Fund. Upon completion of the transfer, the State Police Vehicle
18Maintenance Fund is dissolved, and any future deposits due to
19that Fund and any outstanding obligations or liabilities of
20that Fund shall pass to the State Police Vehicle Fund.

22    Section 20. The Firearm Dealer License Certification Act is
23amended by changing Section 5-70 as follows:

1    Sec. 5-70. Fees and fines deposited in the State Police
2Firearm Services Fund Firearm Dealer License Certification
3Fund. The Department shall set and collect a fee for each
4licensee certifying under this Act. The fee may not exceed $300
5for a certified licensee operating without a retail location.
6The fee may not exceed $1,500 for any certified licensee
7operating with a retail location. The Department may not charge
8a certified licensee in this State, operating under the same or
9different business name, fees exceeding $40,000 for the
10certification of multiple licenses. All fees and fines
11collected under this Act shall be deposited in the State Police
12Firearm Services Fund Firearm Dealer License Certification
13Fund which is created in the State treasury. Moneys in the Fund
14shall be used for implementation and administration of this
15Act.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
