AMENDMENT TO SENATE BILL 2442

2    AMENDMENT NO. ______. Amend Senate Bill 2442 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-697 as follows:
 
7    (20 ILCS 2310/2310-697 new)
8    Sec. 2310-697. Breast cancer; duty of providers of
9mammography services to notify and inform.
10    (a) As used in this Section, "dense breast tissue" means
11heterogeneously dense or extremely dense tissue as defined in
12nationally recognized guidelines or systems for breast imaging
13reporting of mammography screening, including, but not limited
14to, the Breast Imaging Reporting and Data System established by
15the American College of Radiology, and any equivalent new
16terms, as such guidelines are updated.

1    (b) If a patient's mammogram demonstrates dense breast
2tissue, the Department shall require every provider of
3mammography services to include in a summary of the mammography
4report sent to the patient in accordance with the federal
5Mammography Quality Standards Act a notice substantially
6similar to the following:
7        "Your mammogram indicates you have dense breast
8    tissue. Dense breast tissue is normal and identified on
9    mammograms in about 50% of women. Dense breast tissue can
10    make it more difficult to detect cancer on a mammogram and
11    may be associated with an increased risk for breast cancer.
12    Despite these limitations, screening mammograms have been
13    proven to save lives. Continue to have routine screening
14    mammography whether or not additional exams are suggested
15    for you. This information is provided to raise your
16    awareness of the impact of breast density on cancer
17    detection. For further information about dense breast
18    tissue, as well as other breast cancer risk factors,
19    contact your breast imaging health care provider.".
20    (c) A facility that performs mammography may update the
21language in the notice under subsection (b) to reflect advances
22in science and technology, as long as it continues to notify
23patients about dense breast tissue and its effect on the
24accuracy of mammograms and encourage patients to discuss the
25issue with their health care provider.
26    (d) This Section does not create a duty of care or other

1legal obligation beyond the duty to provide notice as set forth
2in this Section.".
