AMENDMENT TO SENATE BILL 1562

2    AMENDMENT NO. ______. Amend Senate Bill 1562, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Abandoned Housing Rehabilitation Act is
6amended by changing Section 2 as follows:
 
7    (310 ILCS 50/2)  (from Ch. 67 1/2, par. 852)
8    Sec. 2. Definitions. As used in this Act:
9    (a) "Property" means any residential real estate which has
10been continuously unoccupied by persons legally in possession
11for the preceding 1 year.
12    (b) "Nuisance" means any property which because of its
13physical condition or use is a public nuisance, or any property
14which constitutes a blight on the surrounding area, or any
15property which is not fit for human habitation under the
16applicable fire, building and housing codes. "Nuisance" also

1means any property on which any illegal activity involving
2controlled substances (as defined in the Illinois Controlled
3Substances Act), methamphetamine (as defined in the
4Methamphetamine Control and Community Protection Act), or
5cannabis (as defined in the Cannabis Control Act) takes place
6or any property on which any streetgang-related activity (as
7defined in the Illinois Streetgang Terrorism Omnibus
8Prevention Act) takes place.
9    (c) "Organization" means any Illinois corporation, agency,
10partnership, association, firm or other entity consisting of 2
11or more persons organized and conducted on a not-for-profit
12basis with no personal profit inuring to anyone as a result of
13its operation which has among its purposes the improvement of
14housing.
15    (d) "Parties in interest" means any owner or owners of
16record, judgment creditor, tax purchaser, the applicable unit
17of local government where the property is located, or other
18party having any legal or equitable title or interest in the
19property.
20    (e) "Last known address" includes the address where the
21property is located, or the address as listed in the tax
22records or as listed pursuant to any owner's registration
23ordinance duly adopted by a home rule unit of government.
24    (f) "Low or moderate income housing" means housing for
25persons and families with low or moderate incomes, provided
26that the income limits for such persons and families shall be

1the same as those established by rule by the Illinois Housing
2Development Authority in accordance with subsection (g) of
3Section 2 of the Illinois Housing Development Act, as amended.
4    (g) "Rehabilitation" means the process of improving the
5property, including, but not limited to, ensuring that the
6proposed improvements conform with a local government's
7comprehensive plan or other planning policies and bringing
8property into compliance with the applicable unit of local
9government's fire, housing, licensing, zoning, and building
10codes.
