AMENDMENT TO SENATE BILL 1085

2    AMENDMENT NO. ______. Amend Senate Bill 1085 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6adding Section 2105-20 as follows:
 
7    (20 ILCS 2105/2105-20 new)
8    Sec. 2105-20. Criminal history records checks. Licensees
9or applicants applying for expedited licensure through an
10interstate compact enacted into law by the General Assembly,
11including, but not limited to, the Interstate Medical Licensure
12Compact Act, who have designated Illinois as the principal
13state of licensure for the purposes of the compact shall have
14his or her fingerprints submitted to the Department of State
15Police in an electronic format that complies with the form and
16manner for requesting and furnishing criminal history record

1information as prescribed by the Department of State Police.
2These fingerprints shall be checked against the Department of
3State Police and Federal Bureau of Investigation criminal
4history record databases now and hereafter filed. The
5Department of State Police shall charge applicants or licensees
6a fee for conducting the criminal history records check, which
7shall be deposited into the State Police Services Fund and
8shall not exceed the actual cost of the records check. The
9Department of State Police shall furnish, pursuant to positive
10identification, records of Illinois convictions to the
11Department. The Department may require applicants or licensees
12to pay a separate fingerprinting fee, either to the Department
13or to a vendor designated or approved by the Department. The
14Department, in its discretion, may allow an applicant or
15licensee who does not have reasonable access to a designated
16vendor to provide his or her fingerprints in an alternative
17manner. The Department may adopt any rules necessary to
18implement this Section. Communication between the Department
19and an interstate compact governing body, including, but not
20limited to, the Interstate Commission as defined in Section 180
21of the Interstate Medical Licensure Compact Act, may not
22include information received from the Federal Bureau of
23Investigation relating to a State and federal criminal history
24records check.
 
25    Section 99. Effective date. This Act takes effect upon
