AMENDMENT TO SENATE BILL 838

2    AMENDMENT NO. ______. Amend Senate Bill 838 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-399.5 as follows:
 
7    (20 ILCS 2310/2310-399.5 new)
8    Sec. 2310-399.5. Veterans' cancer program.
9    (a) The Department, subject to appropriation or other
10available funding, shall conduct a program to promote awareness
11of cancer in veterans. The program may include, but need not be
12limited to:
13        (1) Dissemination of information regarding the
14    incidence of cancer in veterans, the risk factors
15    associated with cancer, and the benefits of early detection
16    and treatment.

1        (2) Promotion of information and counseling about
2    treatment options.
3        (3) Establishment and promotion of referral services
4    and screening programs.
5    Beginning January 1, 2018, the program must include the
6development and dissemination, through print and broadcast
7media, of public service announcements that publicize the
8importance of cancer screening for veterans.
9    (b) Subject to appropriation or other available funding,
10the Veterans' Cancer Screening Program shall be established in
11the Department of Public Health. The Program shall apply to the
12following persons and entities:
13        (1) uninsured and underinsured veterans; and
14        (2) non-profit organizations providing assistance to
15    persons described in paragraph (1).
16    An entity funded by the Program shall coordinate with other
17local providers of cancer screening, diagnostic, follow-up,
18education, and advocacy services for veterans to avoid
19duplication of effort. Any entity funded by the Program shall
20comply with any applicable State and federal standards
21regarding cancer screening.
22    Administrative costs of the Department shall not exceed 10%
23of the funds allocated to the Program. Indirect costs of the
24entities funded by this Program shall not exceed 12%. The
25Department shall define "indirect costs" in accordance with
26applicable State and federal law.

1    An entity funded by the Program shall collect data and
2maintain records that are determined by the Department to be
3necessary to facilitate the Department's ability to monitor and
4evaluate the effectiveness of the entities and the Program.
5Commencing with the Program's second year of operation, by
6January 1, 2019 and every January 1 thereafter, the Department
7shall submit an annual report to the General Assembly and the
8Governor. The report shall describe the activities and
9effectiveness of the Program and shall include, but not be
10limited to, the following types of information regarding those
11served by the Program: (i) the number; and (ii) the ethnic,
12geographic, and age breakdown.
13    The Department or an entity funded by the Program shall
14collect personal and medical information necessary to
15administer the Program from an individual applying for services
16under the Program. The information shall be confidential and
17shall not be disclosed other than for purposes directly
18connected with the administration of the Program or except as
19otherwise provided by law or pursuant to prior written consent
20of the subject of the information.
21    The Department or any entity funded by the program may
22disclose the confidential information to medical personnel and
23fiscal intermediaries of the State to the extent necessary to
24administer the Program, and to other State public health
25agencies or medical researchers if the confidential
26information is necessary to carry out the duties of those

1agencies or researchers in the investigation, control, or
2surveillance of cancer.
3    The Department shall adopt rules to implement the Veterans'
4Cancer Screening Program in accordance with the Illinois
5Administrative Procedure Act.".
