AMENDMENT TO SENATE BILL 709

2    AMENDMENT NO. ______. Amend Senate Bill 709 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Herptiles-Herps Act is amended by changing
5Section 5-30 as follows:
 
6    (510 ILCS 68/5-30)
7    Sec. 5-30. Taking of turtles or bullfrogs; illegal devices.
8    (a) Except as otherwise provided in this Section, no No
9person shall take turtles or bullfrogs by commercial fishing
10devices, including dip nets, hoop nets, traps, or seines, or by
11the use of firearms, airguns, or gas guns. Except as otherwise
12provided in paragraph (3) of subsection (b) of this Section,
13turtles Turtles may be taken only by hand or means of hook and
14line.
15    (b) Bullfrog; common snapping turtle; open season.
16        (1) All individuals taking bullfrogs shall possess a

1    valid sport fishing license and may take bullfrogs only
2    during the open season to be specified by administrative
3    rule. Bullfrogs may only be taken by hook and line, gig,
4    pitchfork, spear, bow and arrow, hand, or landing net.
5        (2) The daily catch limit and total possession limit
6    for all properly licensed persons shall be specified by
7    administrative rule.
8        (3) All persons taking common snapping turtles shall
9    possess a valid sport fishing license and may take common
10    snapping turtles only during the open season to be
11    specified by administrative rule. Common snapping turtles
12    (Chelydra serpentina) may be taken only by hand, hook and
13    line, trap, or bow and arrow, except in the counties listed
14    in Section 5-35 where bowfishing for common snapping
15    turtles is not allowed.
16        (4) The daily catch limit and total possession limit
17    for all properly licensed persons shall be specified by
18    administrative rule.
19    (c) The alligator snapping turtle (Macrochelys temminckii)
20is protected and may not be taken by any method including, but
21not limited to, any sport fishing method.
