SYNOPSIS AS INTRODUCED:
 
520 ILCS 5/2.30  from Ch. 61, par. 2.30

    Amends the Wildlife Code. Provides that it shall be unlawful for any person to trap or to hunt with gun, dog, dog and gun, or bow and arrow, gray fox, red fox, raccoon, weasel, mink, muskrat, badger, bobcat, and opossum except during the open season which will be set annually by the Director to start between 12:01 a.m., November 1 and 12:00 midnight on November 10, and close no earlier than 12:00 midnight on February 15 but not later than 12:00 midnight on March 31, with start and close dates both inclusive (rather than between 12:01 a.m., November 1 to 12:00 midnight February 15, both inclusive). Deletes a provision providing that the season limit for river otter shall not exceed 5 river otters per person per season. Provides that any person who violates the provisions of the Section, including administrative rules, shall be guilty of a Class B misdemeanor.

1    AN ACT concerning wildlife.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Wildlife Code is amended by changing Section
52.30 as follows:
 
6    (520 ILCS 5/2.30)  (from Ch. 61, par. 2.30)
7    Sec. 2.30.
8    (a) It shall be unlawful for any person to trap or to hunt
9with gun, dog, dog and gun, or bow and arrow, gray fox, red
10fox, raccoon, weasel, mink, muskrat, badger, bobcat, and
11opossum except during the open season which will be set
12annually by the Director to start between 12:01 a.m., November
131 and 12:00 midnight on November 10, and close no earlier than
1412:00 midnight on to 12:00 midnight, February 15 but not later
15than 12:00 midnight on March 31, with start and close dates
16both inclusive, except as provided in subsections (e) and (f)
17of this Section.
18    (b) It is unlawful to pursue any fur-bearing mammal with a
19dog or dogs between the hours of sunset and sunrise during the
2010 day period preceding the opening date of the raccoon hunting
21season and the 10 day period following the closing date of the
22raccoon hunting season except that the Department may issue
23field trial permits in accordance with Section 2.34 of this

1Act. A non-resident from a state with more restrictive
2fur-bearer pursuit regulations for any particular species than
3provided for that species in this Act may not pursue that
4species in Illinois except during the period of time that
5Illinois residents are allowed to pursue that species in the
6non-resident's state of residence. Hound running areas
7approved by the Department shall be exempt from the provisions
8of this Section.
9    (c) It shall be unlawful to take beaver, river otter,
10weasel, mink, or muskrat except during the open season set
11annually by the Director, and then, only with traps, except
12that a firearm, pistol, or airgun of a caliber not larger than
13a .22 long rifle may be used to remove the animal from the
14trap.
15    (d) It shall be unlawful for any person to trap beaver or
16river otter with traps except during the open season which will
17be set annually by the Director between 12:01 a.m., November
181st and 12:00 midnight, March 31, both inclusive.
19    (e) Coyote may be taken by trapping methods only during the
20period from September 1 to March 31 1, both inclusive, and by
21hunting methods at any time.
22    (f) Striped skunk may be taken by trapping methods only
23during the period from September 1 to March 31 1, both
24inclusive, and by hunting methods at any time.
25    (g) Muskrat may be taken by trapping methods during an open
26season set annually by the Director.

1    (h) For the purpose of taking fur-bearing mammals, the
2State may be divided into management zones by administrative
3rule.
4    (i) It shall be unlawful to take or possess more than the
5season limit or possession limit of fur-bearing mammals that
6shall be set annually by the Director. The season limit for
7river otter shall not exceed 5 river otters per person per
8season. The season limit for bobcat shall not exceed one bobcat
9per permit. Possession limits shall not apply to fur buyers,
10tanners, manufacturers, and taxidermists, as defined by this
11Act, who possess fur-bearing mammals in accordance with laws
12governing such activities.
13    (j) Nothing in this Section shall prohibit the taking or
14possessing of fur-bearing mammals found dead or
15unintentionally killed by a vehicle along a roadway during the
16open season provided the person who possesses such fur-bearing
17mammals has all appropriate licenses, stamps, or permits; the
18season for which the species possessed is open; and that such
19possession and disposal of such fur-bearing mammals is
20otherwise subject to the provisions of this Section.
21    (k) The provisions of this Section are subject to
22modification by administrative rule, except subsections (a),
23(e), and (f) of this Section.
24    (l) Any person who violates the provisions of this Section,
25including administrative rules, shall be guilty of a Class B
26misdemeanor.
