AMENDMENT TO SENATE BILL 449

2    AMENDMENT NO. ______. Amend Senate Bill 449 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
524A-7 as follows:
 
6    (105 ILCS 5/24A-7)  (from Ch. 122, par. 24A-7)
7    Sec. 24A-7. Rules. The State Board of Education is
8authorized to adopt such rules as are deemed necessary to
9implement and accomplish the purposes and provisions of this
10Article, including, but not limited to, rules (i) relating to
11the methods for measuring student growth (including, but not
12limited to, limitations on the age of useable data; the amount
13of data needed to reliably and validly measure growth for the
14purpose of teacher and principal evaluations; and whether and
15at what time annual State assessments may be used as one of
16multiple measures of student growth), (ii) defining the term

1"significant factor" for purposes of including consideration
2of student growth in performance ratings, (iii) controlling for
3such factors as student characteristics (including, but not
4limited to, students receiving special education and English
5Language Learner services), student attendance, and student
6mobility so as to best measure the impact that a teacher,
7principal, school and school district has on students' academic
8achievement, (iv) establishing minimum requirements for
9district teacher and principal evaluation instruments and
10procedures, and (v) establishing a model evaluation plan for
11use by school districts in which student growth shall comprise
1250% of the performance rating. Notwithstanding any provision in
13this Section, such rules shall not preclude a school district
14having 500,000 or more inhabitants from using an annual State
15assessment as the sole measure of student growth for purposes
16of teacher or principal evaluations.
17    The State Superintendent of Education shall convene The
18rules shall be developed through a process involving
19collaboration with a Performance Evaluation Advisory Council,
20which shall be convened and staffed by the State Board of
21Education. Members of the Council shall be selected by the
22State Superintendent and include, without limitation,
23representatives of teacher unions and school district
24management, persons with expertise in performance evaluation
25processes and systems, as well as other stakeholders. The
26Performance Evaluation Advisory Council shall meet at least

1quarterly, and may also meet at the call of the chairperson of
2the Council, following the effective date of this amendatory
3Act of the 100th 96th General Assembly until June 30, 2021
42017. The Council shall advise the State Board of Education on
5the ongoing implementation of performance evaluations in this
6State, which may include gathering public feedback, sharing
7best practices, consulting with the State Board on any proposed
8rule changes regarding evaluations, and other subjects as
9determined by the chairperson of the Council.
10    Prior to the applicable implementation date, these rules
11shall not apply to teachers assigned to schools identified in
12an agreement entered into between the board of a school
13district operating under Article 34 of this Code and the
14exclusive representative of the district's teachers in
15accordance with Section 34-85c of this Code.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
