AMENDMENT TO SENATE BILL 272

2    AMENDMENT NO. ______. Amend Senate Bill 272 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the State
5Facility Water Management Plan Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Department" means the Department of Public Health.
8    "Facility" means a Veterans Home as defined under Section
91.5 of the Department of Veterans' Affairs Act, a correctional
10institution or facility as defined under Section 3-1-2 of the
11Unified Code of Corrections, a developmental disability
12facility as defined under Section 1-107 of the Mental Health
13and Developmental Disabilities Code, a mental health facility
14as defined under Section 1-114 of the Mental Health and
15Developmental Disabilities Code, or a State-operated mental
16health facility as defined under Section 1-114.1 of the Mental

1Health and Developmental Disabilities Code.
 
2    Section 10. Water management plan required.
3    (a) Every facility must develop a water management plan
4that includes:
5        (1) the establishment of a water management team;
6        (2) a complete breakdown of the potable water system at
7    the facility and the elements of the water system;
8        (3) identification of potential issues and risks to the
9    potable water system;
10        (4) potential remedies and controls for the issues and
11    risks faced by the potable water system; and
12        (5) how detected problems with the potable water system
13    will be communicated to occupants, employees, and the
14    Department.
15    Each facility shall develop a plan under this Section by
16January 1, 2019.
17    (b) Each facility shall review its water management plan
18annually for effectiveness. A facility shall also review its
19water management plan at any time when one or more of the
20following occurs:
21        (1) Legionella is detected at the facility;
22        (2) any construction, modification, or repair
23    activities that may affect a potable water system at the
24    facility is completed; or
25        (3) any other condition specified by the Department by

1    rule occurs.
 
2    Section 15. Legionella sampling; management plan required.
3Each facility shall conduct a Legionella culture sampling and
4develop a management plan for the facility's potable water
5systems by January 1, 2019. The plan developed under this
6Section shall include:
7        (1) provisions requiring Legionella culture sampling
8    annually and at 90-day intervals when Legionella is, or may
9    be, associated with the facility;
10        (2) provisions requiring actions in response to
11    Legionella culture analysis results, including responsive
12    actions, remediation, potential issues, and potential
13    remedies; and
14        (3) any other provisions specified by the Department by
15    rule.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
